- 第二十一条煤矿建设应当坚持煤炭开发与环境治理同步进行。煤矿建设项目的环境保护设施必须与主体工程同时设计、同时施工、同时验收、同时投入使用。 Article 21 In coal mines, coal exploitation and environmental control shall be sychronized. The facilities for environmental protection of a coal mine construction project must be designed, constructed, checked and accepted, and put into use simultaneously with the main project.

- 第二十一条 当事人对有关地方人民政府农牧业部门或者乡级人民政府作出的罚款或者赔偿损失的决定不服的，可以在接到通知之日起一个月内，向人民法院起诉；对有关罚款的决定，期满不起诉又不履行的，有关地方人民政府农牧业部门或者乡级人民政府可以申请人民法院强制执行。 Article 21. If a party concerned disagrees with the decision on a fine or compensation as made by the relevant farming and animal husbandry department of a local people's government or by a people's government at the township level, it may file a suit in a people's court within one month of being informed of the decision. If upon the expiration of the period a party concerned has neither filed a suit nor obeyed the decision by paying the fine, the relevant farming and animal husbandry department of the local people's government or the people's government at the township level may request the people's court for compulsory execution.

The discharge of pollutants and the dumping of wastes into the seas, the construction of coastal projects, and the exploration and exploitation of offshore oil must be conducted in compliance with legal provisions so as to guard against the pollution and damage of the marine environment.
- 第二十一条 运输、装卸、贮存能够散发有毒有害气体或者粉尘的物质，必须按照有关规定采取密闭或者覆盖、喷淋等防护措施。 Article 21. Transportation, loading and unloading, and storage of materials which may issue toxic or other harmful gases, or dusts must be supported by such protective measures as having them handled under airtight conditions, or covered up, or sprayed in accordance with relevant provisions.
- 第二十一条 兴建跨流域引水工程，必须进行全面规划和科学论证，统筹兼顾引出和引入流域的用水需求，防止对生态环境的不利影响。 Article 21. Where an interbasin diversion project is to be built, an overall plan and a scientific justification must be provided, and consideration given to the demand for water in the basin which supplies the water and in the basin which receives it, while adverse effects on the ecological environment shall be avoided.
- 第二十二条 农业生产者应当科学地使用化肥、农药、农用薄膜和饲料添加剂，改进种植和养殖技术，实现农产品的优质、无害和农业生产废物的资源化，防止农业环境污染。 Article 22 Agricultural producers shall use chemical fertilizers, pesticides, agricultural films and feed additive compounds in accordance with scientific principles, improve planting and breeding techniques so as to bring about high-quality, non-hazardous agricultural products and generate resources from wastes from agricultural production and prevent and control agricultural environmental pollution.
- 第二十二条煤矿投入生产前，煤矿企业应当依照本法规定向煤炭管理部门申请领取煤炭生产许可证，由煤炭管理部门对其实际生产条件和安全条件进行审查，符合本法规定条件的，发给煤炭生产许可证。 Article 22 Before a coal mine is put into production, the coal mining enterprise shall, in accordance with the provisions of this Law, submit an application to the department in charge of the coal industry for coal production license. The said department shall examine its actual production and safety conditions before issuing to it the coal production license if the requirements prescribed in this Law are met.
- 第二十二条 用能单位应当加强能源计量管理，健全能源消费统计和能源利用状况分析制度。 Article 22 Energy-using units shall improve their quantitative management in respect of energy, and establish a sound system of energy consumption statistics and of energy utilization analysis.
- 第二十二条企业应当采用原材料利用效率高、污染物排放量少的清洁生产工艺，并加强管理，减少水污染物的产生。 Article 22 Enterprises shall employ clean production techniques that facilitate high utilization efficiency of raw and semi-finished materials and reduced discharge of pollutants and improve management to decrease water pollutants.
- 第二十二条 本法所称工业噪声，是指在工业生产活动中使用固定的设备时产生的干扰周围生活环境的声音。 Article 22 For purposes of this Law, ""industrial noise"" means the sound that is emitted by the permanent equipment used in the course of industrial production and that impairs the living environment of the neighbourhood.
- ??? 第二十二条? 勘查、开采矿产资源时，发现具有重大科学文化价值的罕见地质现象以及文化古迹，应当加以保护并及时报告有关部门。 Article 22 If, in the course of mineral exploration or mining, rare geological phenomena or ancient cultural remains of significant scientific and cultural value are discovered, they shall be protected and reported immediately to the relevant departments.
