- 第十九条 企业应当优先采用能源利用效率高、污染物排放量少的清洁生产工艺，减少大气污染物的产生。 Article 19 Enterprises shall give priority to the adoption of clean production techniques that are instrumental to high efficient use of energy and to reducing the discharge of pollutants so as to decrease the generation of atmospheric pollutants.
- 第十九条开办煤矿企业，必须依法向煤炭管理部门提出申请；依照本法规定的条件和国务院规定的分级管理的权限审查批准。 Article 19 For establishing a coal mining enterprise, an application must be submitted to the department in charge of the coal industry according to law; the application shall be examined for approval in light of the requirements provided for in this Law and by the administrative department at the corresponding level with the authorization of the State Council.
- 第十九条 在城市范围内从事生产活动确需排放偶发性强烈噪声的，必须事先向当地公安机关提出申请，经批准后方可进行。当地公安机关应当向社会公告。 Article 19 In the case where sporadic strong noise is truly unavoidable in production conducted within an urban area, the matter must first be applied to the local public security organ for approval. Upon giving approval, the local public security organ shall make it known to the public.
- 第十九条整治河道和修建控制引导河水流向、保护堤岸等工程，应当兼顾上下游、左右岸的关系，按照规划治导线实施，不得任意改变河水流向。 Article 19 In the realigning of river courses and building up construction projects for leading the river direction or protecting embankments, full consideration should be given to the relations between the lower and upper reaches and between both sides of a river and the planned realigning and leading line be followed. The direction of a river shall not be changed at will.

- 第十九条矿山企业对使用机械、电气设备，排土场、矸石山、尾矿库和矿山闭坑后可能引起的危害，应当采取预防措施。 Article 19 Mining enterprises shall take preventive measures against perils that may arise out of using mechanical and electrical equipment, soil tips, mine tips, dams and lagoons, as well as from disused mine pits.
- 第十九条 地方各级人民政府应当组织有关部门建立护林组织，负责护林工作；根据实际需要在大面积林区增加护林设施，加强森林保护；督促有林的和林区的基层单位，订立护林公约，组织群众护林，划定护林责任区，配备专职或者兼职护林员。 Article 19 The local people's government at various levels shall organize competent authorities to establish a forest protection organization to take charge of the work of forest protection; add forest protection facilities and enhance forest protection in light of actual needs; and urge grass-roots organizations with forests and in forest districts to conclude forest protection covenants, mobilize the masses to protect forests, delimit forest protection responsibility zones, and provide full-time or part-time forest protection personnel.

- 第十九条在山区、丘陵区、风沙区修建铁路、公路、水工程，开办矿山企业、电力企业和其他大中型工业企业，在建设项目环境影响报告书中，必须有水行政主管部门同意的水土保持方案。 Article 19 When the construction of a railway, highway or a water project is carried out, a mining or electrical power enterprise or any other large or medium-sized industria1; enterprise is established in a mountainous, hilly or sandstorm area, the environmental impact statement for the project must include a water and soil conservation programme approved by the department of water administration.

Departments of fishery administration under the people's governments at and above the county level shall work out overall plans and take measures to increase fishery resources in the fishery waters under their jurisdiction. These departments may collect fees from the units and individuals profited by the use of such waters and devote the money thus collected to the increase and protection of fishery resources. The procedures for collecting such fees shall be formulated by the department of fishery administration and the department of finance under the State Council, and must be approved by the State Council before going into effect.
- 第十九条 含强放射性物质的废水，禁止向海域排放。 Article 19. It is prohibited to discharge waste water containing high-level radioactive matter into the sea.

- 第十九条 工业生产中产生的焦炉煤气、高炉煤气和稳定抽放的煤矿瓦斯、合成氨驰放气等可燃性气体应当回收利用。 Article 19. Such combustible gases produced in the course of industrial production as coke oven gas, blast furnace gas, and gases released at a steady rate from coal mines and synthetic ammonia should be recycled and utilized.
- 第十九条 修建闸坝、桥梁、码头和其他拦河、跨河、临河建筑物，铺设跨河管道、电缆，必须符合国家规定的防洪标准、通航标准和其他有关的技术要求。 Article 19. The building of any dam and sluice gate, bridge, wharf or any structure which blocks, crosses or borders a river channel, and the laying of a pipeline or a cable which crosses a river, must be in conformity with the standards for the prevention of floods and navigation and other related technical requirements set by the state.
- 第十九条 违反本法规定开垦草原的，县级以上地方人民政府农牧业部门有权责令停止开垦，恢复植被；情节严重的，还可以处以罚款。 Article 19. The farming and animal husbandry departments of the local people's governments at the county level or above shall have the power to order anyone who reclaims grassland in violation of the provisions of this Law to stop reclaiming it and restore vegetation; a fine may be imposed in serious cases.
- 第二条在中华人民共和国领域和中华人民共和国管辖的其他海域从事矿产资源开采活动，必须遵守本法。 Article 2 All activities relating to exploitation of mineral resources conducted within the boundaries of the People's Republic of China, as well as in other sea areas under its jurisdiction must comply with this Law.
- 第二条在中华人民共和国境内从事野生动物的保护、驯养繁殖、开发利用活动，必须遵守本法。 Article 2 All activities within the territory of the People's Republic of China concerning the protection, domestication, breeding, development and utilization of species of wildlife must be conducted in conformity with this Law.
- 第二条本法所称水土保持，是指对自然因素和人为活动造成水土流失所采取的预防和治理措施。 Article 2 As used in this Law, the term ""water and soil conservation"" means preventive and rehabilitative measures taken against soil erosion which is caused by natural factors or human activities.
- 第二条 本法所称清洁生产，是指不断采取改进设计、使用清洁的能源和原料、采用先进的工艺技术与设备、改善管理、综合利用等措施，从源头削减污染，提高资源利用效率，减少或者避免生产、服务和产品使用过程中污染物的产生和排放，以减轻或者消除对人类健康和环境的危害。 Article 2 Cleaner production as used in this Law means the continuous application of measures for design improvement, utilization of clean energy and raw materials, the implementation of advanced processes, technologies and equipment, improvement of management and comprehensive utilization of resources to reduce pollution at source, enhance the rates of resource utilization efficiency, reduce or avoid pollution generation and discharge in the course of production, provision of services and product use, so as to decrease harm to the health of human beings and the environment.
- 第二条在中华人民共和国境内开采煤炭资源的煤矿企业，必须依照本办法的规定，领取煤炭生产许可证。 Article 2 Coal production enterprises mining coal within the territory of the People’s Republic of China must obtain a coal production license in accordance with provisions of the Measures.
- 第二条 本法所称环境噪声，是指在工业生产、建筑施工、交通运输和社会生活中所产生的干扰周围生活环境的声音。 Article 2 For purposes of this Law, ""environmental noise"" means the sound that is emitted in the course of industrial production, construction, transportation and social activities and that impairs the living environment of the neighbourhood.
- 第二条 本办法所称再生资源，是指在社会生产和生活消费过程中产生的，已经失去原有全部或部分使用价值，经过回收、加工处理，能够使其重新获得使用价值的各种废弃物。 Article 2 The renewable resources as mentioned in these Measures refer to all kinds of wastes that are generated in social production and living and consumption, and that have lost all or part of their use value, but can regain use value through recovery and processing.
