- 经证明，航空运输中的损失是由于承运人的受雇人、代理人的故意或者明知可能造成损失而轻率地作为或者不作为造成的，不适用本条第一款和第二款的规定。 The provisions of paragraphs 1 and 2 of this Article shall not apply if it is proved that the damage in air transport resulted from an act or omission of the servant or agent of the carrier done with intent to cause damage or recklessly and with knowledge that damage would probably result.
- 前款诉讼是对承运人的受雇人或者代理人提起的，经承运人的受雇人或者代理人证明，其行为是在受雇或者受委托的范围之内的，适用前款规定。 The provisions of the preceding paragraph shall apply if the action referred to in the preceding paragraph is brought against the carrier's servant or agent, and the carrier's servant or agent proves that his action was within the scope of his employment or agency.
- 前款规定，不影响承运人就非集装箱装运的货物，在装船前和卸船后所承担的责任，达成任何协议。 The provisions of the preceding paragraph shall not prevent the carrier from entering into any agreement concerning carrier's responsibilities with regard to non-containerized goods prior to loading onto and after discharging from the ship.

- 承运人非集装箱装运的货物的责任期间，是指从货物装上船时起至卸下船时止，货物处于承运人掌管之下的全部期间。 The responsibility of the carrier with respect to non-containerized goods covers the period during which the carrier is in charge of the goods, starting from the time of loading of the goods onto the ship until the time the goods are discharged therefrom.
- 禁航区由主管机关公布。 The restricted navigation zones shall be announced by the competent authority.
- 救助报酬不得超过船舶和其他财产的获救价值。 The reward shall not exceed the value of the ship and other property salved.
