- （二）货物共同海损牺牲的金额，货物灭失的，按照货物在装船时的价值加保险费加运费，减除由于牺牲无需支付的运费计算。 (2) The amount of sacrifice of the goods already lost shall be calculated on the basis of the value of the goods at the time of shipment plus insurance and freight, from which the freight that need not be paid due to the sacrifice made being deducted.
- （二）有必需的依法取得执照的航空人员； (2) The availability of necessary airmen who have been issued licences according to law; and

- （二）依照中华人民共和国法律设立的企业法人的民用航空器；企业法人的注册资本中有外商出资的，其机构设置、人员组成和中方投资人的出资比例，应当符合行政法规的规定； (2) The civil aircraft of a corporate enterprise set up in accordance with the law of the People's Republic of China; if such corporate enterprise has foreign investment in its registered capital, its organizational structure and composition of personnel, and the proportion of contribution of Chinese investor shall conform to the provisions of administrative rules and regulations; and
- （二）修建靶尝强烈爆炸物仓库等影响飞行安全的建筑物或者设施； (2) The construction of buildings or facilities that will affect flight safety such as shooting range and storage of strong explosives;
- （二）货物共同海损分摊价值，按照货物在装船时的价值加保险费加运费，减除不属于共同海损的损失金额和承运人承担风险的运费计算。 (2) The contributory value of the goods shall be calculated on the basis of the value of the goods at the time of shipment plus insurance and freight, from which the damage that does not come under the general average sacrifice and the carrier's freight at risk being deducted.
- （二）为受害人同经营人或者同发生损害时对民用航空器有使用权的人订立的合同所约束，或者为适用两方之间的劳动合同的法律有关职工赔偿的规定所约束的损害； (2) The damage which is regulated either by a contract between the person who suffers such damage and the operator or the person entitled to use the civil aircraft at the time the damage occurred, or by the law relating to workman's compensation applicable to a contract of employment between such persons; and
- （二）请求保全的证据对该海事请求具有证明作用； (2) The evidence to be preserved on application provides proof for the maritime claim;
- （二）飞行高度足以使该航空器在发生紧急情况时离开城市上空，而不致危及地面上的人员、财产安全的； (2) The flight altitude is high enough to permit the civil aircraft to leave the airspace over the city in the event of emergency without undue hazard to persons or property on the surface;
- （二）货物的保险价值，是保险责任开始时货物在起运地的发票价格或者非贸易商品在起运地的实际价值以及运费和保险费的总和； (2) The insurable value of the cargo shall be the aggregate of the invoice value of the cargo or the actual value of the non-trade commodity at the place of shipment, plus freight and insurance premium when the insurance liability commences;
- （二）有关此项债权的诉讼已经开始。 (2) The legal action concerning the obligatory rights has started.
- （二）对托运行李或者货物的赔偿责任限额，每公斤为１７计算单位。旅客或者托运人在交运托运行李或者货物时，特别声明在目的地点交付时的利益，并在必要时支付附加费的，除承运人证明旅客或者托运人声明的金额高于托运行李或者货物在目的地点交付时的实际利益外，承运人应当在声明金额范围内承担责任。 (2) The liability of the carrier for each kilogram of checked baggage or cargo is limited to a sum of 17 units of account. If the passenger or shipper has made, at the time when the package was handed over to the carrier, a special declaration of interest in delivery at destination and has paid a supplementary sum if the case so requires, the carrier shall be liable to pay a sum not exceeding the declared sum, unless he proves that the sum declared by the passenger or shipper is greater than the actual interest of the checked baggage or cargo in delivery at destination.
- （二）与船舶营运直接有关的人身伤亡； (2) the loss of life or personal injury directly relating to the operation of the ship;
