- 专利复审委员会进行复审后，认为原驳回决定不符合专利法和本细则有关规定的，或者认为经过修改的专利申请文件消除了原驳回决定指出的缺陷的，应当撤销原驳回决定，由原审查部门继续进行审查程序。 Where the Patent Re-examination Board considers after re-examination that the original decision on rejection is not in conformity with relevant provisions in the Patent Law or these Rules, or considers that the defects pointed out in the original decision on rejection have been eliminated from the amended patent application documents, it shall revoke the original decision on rejection, and the original examination department shall continue the examination procedures.
- 专利复审委员会决定对无效宣告请求进行口头审理的，应当向当事人发出口头审理通知书，告知举行口头审理的日期和地点。当事人应当在通知书指定的期限内作出答复。 Where the Patent Re-examination Board decides to hear the request for invalidation orally, it shall send a notification on the oral hearing to the party concerned, informing the date and place for holding the oral hearing. The party concerned shall make a response within the time limit specified in the notification.
- 对专利复审委员会宣告专利权无效或者维持专利权的决定不服的，可以自收到通知之日起三个月内向人民法院起诉。 Where the patentee or the person who made the request for invalidation is not satisfied with the decision of the Patent Reexamination Board declaring the patent right invalid or upholding the patent right, such party may, within three months from receipt of the notification of the decision, institute legal proceedings in the people's court.
- 人民法院不予执行的，当事人可以就合同纠纷向人民法院起诉。 Where the people's court refuses to execute an arbitration award, the parties may institute proceedings in a people's court for contractual dispute.
- 吊销《许可证》的，可以同时没收其使用的卫星地面接收设施。 Where the permit is revoked, the ground satellite receiving facilities may also be confiscated concurrently.
- 无效宣告请求人对专利复审委员会发出的口头审理通知书在指定的期限内未作答复，并且不参加口头审理的，其无效宣告请求视为撤回；专利权人不参加口头审理的，可以缺席审理。 Where the person making the request for invalidation has not made any response within the time limit specified in the notification on oral hearing sent by the Patent Re-examination Board, and does not participate in the oral hearing, the request for invalidation shall be deemed to have been withdrawn; where the patent holder does not participate in the oral hearing, the case may be heard by default.
- 无效宣告请求人在专利复审委员会作出决定之前撤回其请求的，无效宣告请求审查程序终止。 Where the person making the request for invalidation withdraws his request before the Patent Re-examination Board makes the decision, the procedures for examining the request for invalidation shall be terminated.
- 复审请求人在专利复审委员会作出决定前撤回其复审请求的，复审程序终止。 Where the person making the request withdraws his request for re-examination before the Patent Re-examination Board makes a decision on the request, the re-examination procedures shall be terminated.
- 拾得人侵占遗失物的，无权请求保管遗失物等支出的费用，也无权请求权利人按照承诺履行义务。 Where the person who finds the object misappropriates the lost object, he/she shall be deprived of the right to ask for paying the expenses he/she has paid for safekeeping the object or require the holder to perform the obligation as promised.
- 期满未办理规定手续的，该申请视为撤回。 where the provided formalities have not been fulfilled at the expiry of the time limit, the application shall be deemed to have been withdrawn.
- 共有人分割所得的不动产或者动产有瑕疵的，其他共有人应当分担损失。 Where the realty or chattel, which is obtained from the partition of a commonly owned realty or chattel by a co-owner, has any flaw, the other co-owners shall assume the losses together.
- 逾期增加理由或者补充证据的，专利复审委员会可以不予考虑。 Where the reasons are increased or the evidence is supplemented after the expiry of the time limit, the Patent Re-examination Board need not take the request into account.
- 要求外国优先权的，申请人提交的在先申请文件副本应当经原受理机关证明； Where the right of foreign priority is claimed, the copies of the earlier application documents submitted by the applicant shall be certified by the original acceptance authority.
- 优先权要求在国际阶段视为未提出并经国际局公布该信息，申请人有正当理由的，可以在办理进入中国国家阶段手续时请求国务院专利行政部门恢复其优先权要求。 Where the right of priority is deemed to have not been claimed in the International Phase and this information has been announced by the International Bureau, the applicant may, when fulfilling the formalities for the entry of the National Phase in China, request with justified reasons the administrative department for patent under the State Council to recover its claim for the right of priority.
- 转让专利申请权或者专利权的，当事人应当订立书面合同，并向国务院专利行政部门登记，由国务院专利行政部门予以公告。 Where the right to apply for a patent or the patent right is assigned, the parties shall conclude a written contract and register it with the patent administration department under the State Council.? The patent administration department under the State Council?shall announce the registration.
- 期满未缴纳或者未足额缴纳的，国际申请中未经检索或者未经国际初步审查的部分视为撤回。 Where the said fee has not been paid or fully paid at the expiry of the time limit, the parts in the international application which have not undergone retrieval or international preliminary examination shall be deemed to have been withdrawn.
- 书面声明中未写明在先申请的申请日和受理该申请的国家的，视为未提出声明。 Where the written declaration does not contain the application date of the earlier application or the name of the said country, the declaration shall be deemed to have not been made.
- 复审请求书不符合规定格式的，复审请求人应当在专利复审委员会指定的期限内补正； Where the written request for re-examination is not in conformity with the provided format, the person making the request shall rectify it within the time limit specified by the Patent Re-examination Board.
- 本章没有规定的，适用专利法及本细则其他各章的有关规定。 where there are no relevant provisions in this Chapter, they shall be subject to the relevant provisions in the Patent Law and other Chapters of these Rules.
- 权利要求书有几项权利要求的，应当用阿拉伯数字顺序编号。 Where there are several claims in the patent claim, they shall be numbered consecutively in Arabic numerals.
- 申请人有２人以上且未委托专利代理机构的，除请求书中另有声明的外，以请求书中指明的第一申请人为代表人。 Where there are two or more applicants and none of them has entrusted a patent agency, the first applicant designated in the written request shall be regarded as the representative unless otherwise declared in the written request.
- 该月无相应日的，以该月最后一日为期限届满日；期限届满日是法定节假日的，以节假日后的第一个工作日为期限届满日。 where there is no corresponding day in that month, the time limit shall expire on the last day of that month; and where a time limit expires on a statutory holiday, it shall expire on the first working day following that statutory holiday.
- 本规定与国际著作权条约有不同规定的，适用国际著作权条约。 Where these Provisions conflict with the international copyright treaties, the international copyright treaties shall apply.
- 期满未提交证明的，该样品视为未提交保藏； where they have not been submitted at the expiry of the time limit, the sample shall be deemed to have not been deposited;
- 依照专利法第三十一条第二款规定将两项以上外观设计作为一件申请提出的，应当将各项外观设计顺序编号标在每件使用外观设计产品的视图名称之前。 Where two or more designs are filed as one application in accordance with the Paragraph 2 of Article 31 of the Patent Law, they shall be numbered consecutively and each number shall be placed before the corresponding title of the view of the product incorporating the design.
