- 文件送交地址不清，无法邮寄的，可以通过公告的方式送达当事人。自公告之日起满１个月，该文件视为已经送达。 Where the address to which a document is to be served is not clear for the purpose of mailing, the document may be served by announcement, and shall be deemed to have been served at the expiry of 1 month as of the date of announcement.
- 管理专利工作的部门违反前款规定的，由其上级机关或者监察机关责令改正，消除影响， Where the administrative authority for patent affairs violates the provisions of the preceding paragraph, it shall be ordered by the authority at the next higher level or the supervisory authority to correct its mistakes and eliminate the bad effects.
- 国务院专利行政部门认为一件专利申请不符合专利法第三十一条和本细则第三十五条或者第三十六条的规定的，应当通知申请人在指定期限内对其申请进行修改； Where the administrative department for patent under the State Council considers that the application for one patent as not in conformity with Article 31 of the Patent Law and Article 35 or Article 36 of these Rules, it shall notify the applicant to amend the application within a specified time limit;
- 国务院专利行政部门自行修改的，应当通知申请人。 Where the administrative department for patent under the State Council has made such amendment at its own discretion, it shall notify the applicant.
- 申请人补交附图的，以向国务院专利行政部门提交或者邮寄附图之日为申请日；取消对附图的说明的，保留原申请日。 Where the appended drawings are re-submitted later, the date of their delivery at, or mailing to, the administrative department for patent under the State Council, shall be regarded as the application date; where the explanatory notes to the appended drawings are deleted, the original application date shall be reserved.
- 申请人在收到国务院专利行政部门发出的审查意见通知书后对专利申请文件进行修改的，应当按照通知书的要求进行修改。 Where the applicant amends his/its patent application documents upon his/its receipt of the notification of the opinions from the examination which is sent out by the administrative department for patent under the State Council, he/it shall make the amendment in accordance with the requirements of the notification.
- 申请人要求本国优先权的，其在先申请自后一申请提出之日起即视为撤回。 Where the applicant claims the right of domestic priority, the earlier application shall be deemed to be withdrawn as of the date on which the later application is filed.
- 申请人在前款规定的期限内未办理进入中国国家阶段手续的，在缴纳宽限费后，可以在自优先权日起２２个月或者３２个月的相应期限届满前办理。 Where the applicant fails to fulfill the formalities for the entry of the National Phase in China within the time limit provided in the preceding paragraph, he/it may, after paying the fee for extending the time limit, fulfill the formalities prior to the expiry of a corresponding period of 22 or 32 months commencing from the priority date.
- 申请人未依照本条第二款的规定提出声明和提交证明文件的，或者未依照本条第三款的规定在指定期限内提交证明文件的，其申请不适用专利法第二十四条的规定。 Where the applicant fails to make a declaration and submit the certified document in accordance with Paragraph 2 of this Article, or fails to submit the certified document within a specified time limit in accordance with Paragraph 3 of this Article, the application may not be subject to Article 24 of the Patent Law.
- 申请人未满足前款第（一）项、第（二）项和第（三）项要求的，国务院专利行政部门应当通知申请人在指定期限内补正。 Where the applicant fails to meet the requirements in Item (1), Item (2) and Item (3) of the preceding paragraph, the administrative department for patent under the State Council shall notify the applicant to make a rectification within the specified time limit.
- 申请人未满足本条第一款第（四）项要求的，其申请不适用专利法第二十四条的规定。 Where the applicant fails to meet the requirements in Item (4) of Paragraph 1 of this Article, his/its application shall not be subject to Article 24 of the Patent Law.
- 申请人在国际阶段未提交在先申请文件副本的，国务院专利行政部门认为必要时，可以通知申请人在指定期限内补交。 Where the applicant fails to submit the copies of the earlier application documents in the International Phase, the administrative department for patent under the State Council may, when considering it necessary, notify the applicant to supplement them within a specified time limit.
- 专利申请人对专利复审委员会的复审决定不服的，可以自收到通知之日起三个月内向人民法院起诉。 Where the applicant for patent?is not satisfied with the decision of the Patent Reexamination Board, it or he may, within three months from the date of receipt of the notification, institute legal proceedings in the people's court.
- 申请人在国际阶段提出的优先权书面声明有书写错误或者未写明在先申请的申请号的，可以在办理进入中国国家阶段手续时提出改正请求或者写明在先申请的申请号。 Where the applicant has any written errors in the written declaration for the right of priority made in the International Phase or does not indicate the application number of the earlier application, he/it may, when fulfilling the formalities for the entry of the National Phase in China, make a request for a correction or indicate the application number of the earlier application.
- 申请人提出改正请求的，应当缴纳改正优先权要求请求费。 Where the applicant has made a request for a correction, he/it shall pay a fee for requesting the correction of the right of priority.
- 申请人期满未答复的，其申请视为撤回。 Where the applicant has not given any response at the expiry of the time limit, the application shall be deemed to have been withdrawn.
- 申请人期满未答复的，该申请视为撤回。 分案的申请不得改变原申请的类别。 where the applicant has not given any response at the expiry of the time limit, the application shall be deemed to have been withdrawn. The division of application may not change the category of the original application.
- 期限届满申请人未补正的，其申请视为撤回。 Where the applicant has not rectified his/its application at the expiry of the time limit, the application shall be deemed to have been withdrawn.
- 申请人期满未补交的，其优先权要求视为未提出。 Where the applicant has not supplemented them at the expiry of the time limit, his/its right of priority shall be deemed to have not been claimed.
- 申请人在国际阶段已依照专利合作条约的规定，提交过在先申请文件副本的，办理进入中国国家阶段手续时不需要向国务院专利行政部门提交在先申请文件副本。 Where the applicant has submitted the copies of the earlier application documents in the International Phase in accordance with the Patent Cooperation Treaty, he/it needs not to submit the copies of the earlier application documents to the administrative department for patent under the State Council when fulfilling the formalities for the entry of the National Phase in China.
- 申请人改正译文错误的，应当提出书面请求，提交译文的改正页，并缴纳规定的译文改正费。 Where the applicant is to correct errors in the translation, he/it shall make a written request, submit the corrected page of the translation and pay the provided fee for correcting the translation.
- 申请人按照国务院专利行政部门的通知书的要求改正译文的，应当在指定期限内办理本条第二款规定的手续； Where the applicant is to correct the translation as required in the notification of the administrative department for patent under the State Council, he/it shall, within a specified time limit, fulfill the formalities provided in Paragraph 2 of this Article;
- 申请人在办理进入中国国家阶段手续之日起４个月内向国务院专利行政部门提交生物材料样品保藏证明和存活证明的，视为在本细则第二十五条第（一）项规定的期限内提交。 Where the applicant submits the receipt of deposit and the viability proof on the sample of the biomaterial to the administrative department for patent under the State Council within 4 months as of the date when he/it fulfilled the formalities for the entry of the National Phase in China, he/it shall be deemed to have submitted them within the time limit provided in Item (1) of Article 25 of these Rules.
- 侵权行为情节严重、构成犯罪的，要依法追究有关人员的刑事责任，切实维护知识产权权利人的合法权益，维护社会主义法制的统一和尊严。 Where the case of infringement is so serious that a crime is committed, the relevant offender should be prosecuted for his criminal liability according to law so as to safeguard conscientiously the lawful rights and interests of owners of intellectual property rights as well as the unity and dignity of the socialist legal system.
- 在该期间内未提交中文译文的，对申请人在国际阶段提出的修改，国务院专利行政部门不予考虑。 Where the Chinese translation is not submitted within this period, the administrative department for patent under the State Council shall not take the amendment requested by the applicant in the International Phase into account.
