- （２）自行改变注册商标的注册人名义、地址或者其他注册事项的； (2) where the name, address or other registered matters concerning the registrant of a registered trademark are changed unilaterally (that is, without the required application);
- （二）在专利申请日前已经制造相同产品、使用相同方法或者已经作好制造、使用的必要准备，并且仅在原有范围内继续制造、使用的； (2) Where, before the date of filing of the application for patent, any person who has already made the identical product, used the identical process, or made necessary preparations for its making or using, continues to make or use it within the original scope only;
- （二）实用新型专利申请是否明显属于专利法第五条、第二十五条的规定，或者不符合专利法第十八条、第十九条第一款的规定，或者明显不符合专利法第二十六条第三款、第四款、第三十一条第一款、第三十三条、本细则第二条第二款、第十三条第一款、第十八条至第二十三条、第四十三条第一款的规定，或者依照专利法第九条规定不能取得专利权； (2) whether an application for a patent for utility model obviously falls under Article 5 or Article 25 of the Patent Law, or is not in conformity with the provisions of Article 18 or Paragraph 1 of Article 19 of the Patent Law, or is obviously not in conformity with Paragraphs 3 and 4 of Article 26, Paragraph 1 of Article 31, Article 33 of the Patent Law, or Paragraph 2 of Article 2, Paragraph 1 of Article 13, Articles 18 to 23, Paragraph 1 of Article 43 of these Rules, or is not entitled to a patent right in accordance with Article 9 of the Patent Law;
- （二）在收到国务院专利行政部门发出的发明专利申请进入实质审查阶段通知书之日起３个月内。 (2) within 3 months as of the receipt of the notification sent by the administrative department for patent under the State Council on the entry of the application for a patent for invention into the stage of substantial examination.
- （二）未经许可，在广告或者其他宣传材料中使用他人的专利号，使人将所涉及的技术误认为是他人的专利技术； (2) without permission, using the patent number of another person in the advertisement or other propaganda materials, thus causing people to mistake the technology involved with the other person's patented technology;
- （二）法律、行政法规规定或者合同约定著作权由法人或者非法人单位享有的职务作品。 (2) works created in the course of employment where the copyright is, in accordance with laws, administrative rules and regulations or contracts concerned, enjoyed by the legal person or entity without legal personality.
- （二）作者不是国际著作权条约成员国的国民或者在该条约的成员国有经常居 所的居民，但是在该条约的成员国首次或者同时发表的作品； (2) works of which the author is not a national or a permanent resident of a country party to internatioaal copyright treaties but which have been first published or published simultaneously in a country party of the international copy right treaties;
- （20）正确处理专利保护和公共利益的关系。在依法保护专利权的同时，完善强制许可制度，发挥例外制度作用，研究制定合理的相关政策，保证在发生公共危机时，公众能够及时、充分获得必需的产品和服务。 (20) We shall properly handle the relationship between patent protection and public interests. Efforts shall be made to improve compulsory licensing system, give play to exception system, study formulation of reasonable relevant policies and ensure public to be able to obtain necessary products and services in a timely and adequate manner in public crises while protecting patent rights by law.
- （23）充分发挥商标在农业产业化中的作用。积极推动市场主体注册和使用商标，促进农产品质量提高，保证食品安全，提高农产品附加值，增强市场竞争力。 (23) We shall give full play of trademark in agricultural industrialization, actively boosting registration and utilization of trademarks by market subjects and improving quality of agricultural products to ensure food safety, raise additional values of agricultural products and enhance market competitiveness.
- （25）扶持新闻出版、广播影视、文学艺术、文化娱乐、广告设计、工艺美术、计算机软件、信息网络等版权相关产业发展，支持具有鲜明民族特色、时代特点作品的创作，扶持难以参与市场竞争的优秀文化作品的创作。 (25) We shall support development of industries concerning copyright including press, publication, broadcasting, film, TV, literature, art, cultural recreation, advertisement design, industrial art, software, information and website, and creation of works with distinctive national and time characteristics and excellent cultural works yet difficult to participate in market competition.
- （26）完善制度，促进版权市场化。进一步完善版权质押、作品登记和转让合同备案等制度，拓展版权利用方式，降低版权交易成本和风险。充分发挥版权集体管理组织、行业协会、代理机构等中介组织在版权市场化中的作用。 (26) We shall improve systems and advance copyright to go to market. Efforts shall be made to further perfect systems such as copyright mortgage, work registration and filing of transference contracts, expand utilizing modes of copyright and reduce costs and risks in copyright trades. We shall give fully play to role of intermediary organizations such as copyright collective administration organizations, trades societies and agencies in copyright marketization.
- （27）依法处置盗版行为，加大盗版行为处罚力度。重点打击大规模制售、传播盗版产品的行为，遏制盗版现象。 (27) We shall punish piracy by law and intensify punishments on piracy, mainly cracking down large-scale production, sale and promulgate pirated products and reducing piracies.
- （28）有效应对互联网等新技术发展对版权保护的挑战。妥善处理保护版权与保障信息传播的关系，既要依法保护版权，又要促进信息传播。 (28) We shall meet challenges on copyright protection from development of new technologies such as internet effectively, and deal with relationship between copyright protection and guarantee of information promulgation, promoting promulgation of information while protecting of copyright by law.
- （三） 仓单、提单； (3) warehouse receipts and lading bills;
- （三）临时通过中国领陆、领水、领空的外国运输工具，依照其所属国同中国签订的协议或者共同参加的国际条约，或者依照互惠原则，为运输工具自身需要而在其装置和设备中使用有关专利的； (3) Where any foreign means of transport which temporarily passes through the territory, territorial waters or territorial airspace of China uses the patent concerned, in accordance with any agreement concluded between the country to which the foreign means of transport belongs and China, or in accordance with any international treaty to which both countries are party, or on the basis of the principle of reciprocity, for its own needs, in its devices and installations;
- （三）与当事人或者其代理人有其他关系，可能影响公正审查和审理的； (3) where he has such other kinds of relations with the party concerned or the latter's agent that might affect impartial examination and hearing;
- （三）属于按照规定提出的分案申请的。 (3) where it belongs to divisional application filed as provided.
- （三）他人未经申请人同意而泄露其内容的。 (3) where it was disc1osed by any person without the consent of the applicant.
- （三）申请人委托专利代理机构的，应当注明的有关事项；申请人未委托专利代理机构的，其联系人的姓名、地址、邮政编码及联系电话； (3) where the applicant has entrusted a patent agency, the relevant matters to be indicated; where the applicant has not entrusted a patent agency, the name, address, postal code and telephone number of the contact;
- （三）不符合本细则第一百二十条第一款规定的； (3) where the application is not in conformity with Paragraph 1 of Article 120 of these Rules;
- （３）自行转让注册商标的； (3) where the registered trademark is assigned unilaterally (that is, without the required approval);
- （三）外观设计专利申请是否明显属于专利法第五条的规定，或者不符合专利法第十八条、第十九条第一款的规定，或者明显不符合专利法第三十一条第二款、第三十三条、本细则第二条第三款、第十三条第一款、第四十三条第一款的规定，或者依照专利法第九条规定不能取得专利权。 (3) whether an application for a patent for design obviously falls under Article 5 of the Patent Law, or is not in conformity with Article 18 or Paragraph 1 of Article 19 of the Patent Law, or is obviously not in conformity with Paragraph 2 of Article 31, Article 33 of the Patent Law, or Paragraph 3 of Article 2, Paragraph 1 of Article 13 or Paragraph 1 of Article 43 of these Rules, or is not entitled to a patent rights in accordance with Article 9 of the Patent Law.
- （三）故意破坏国家保护的珍贵文物或者名胜古迹的； (3) wilful damage of valuable cultural relics or places of cultural and historical interest under state protection; and
- （三）退职、退休或者调动工作后１年内作出的，与其在原单位承担的本职工作或者原单位分配的任务有关的发明创造。 (3) within 1 year from his resignation, retirement or change of work, provided that the invention-creation relates to his own duty or to the other task distributed to him by the entity to which he previously belonged.
- （三）未经许可，在合同中使用他人的专利号，使人将合同涉及的技术误认为是他人的专利技术； (3) without permission, using the patent number of another person in the contract, thus causing people to mistake the technology involved in the contract with the other person's patented technology;
