- 期满未补正第（一）项或者第（二）项内容的，该申请视为撤回；期满未补正第（三）项内容的，该优先权要求视为未提出。 Where the contents in Item (1) or (2) have not been rectified at the expiry of the time limit, the application shall be deemed to have been withdrawn; where the contents in Item (3) have not been rectified at the expiry of the time limit, the right of priority shall be deemed to have not been claimed.
- 著作权属于法人或者非法人单位的，法人或者非法人单位变更、终止后，其作品的使用权和获得报酬权在本法规定的保护期内，由承受其权利义务的法人或者非法人单位享有；没有承受其权利义务的法人或者非法人单位的，由国家享有。 Where the copyright in a work belongs to a legal person or entity without legal personality, the right of exploitation and the right to remuneration shall, after the change or the termination of the legal person or entity without legal personality, during the term of protection provided for in this Law, be enjoyed by the succeeding legal person or entity without legal personality which has taken over the former's rights and obligations, or, in the absence of such a successor entity, by the state.
- 管理专利工作的部门认为被请求人提出的中止理由明显不能成立的，可以不中止处理。 Where the department for the administration of patent work considers that the reason for suspension given by the respondent is obviously untenable, it may refuse to suspend the disposal.
- 要求本国优先权的，申请人提交的在先申请文件副本应当由国务院专利行政部门制作。 Where the domestic right of priority is claimed, the copies of the earlier application documents shall be prepared by the administrative department for patent under the State Council.
- 国际申请在中国的效力已经终止的，不适用本细则第七条第二款的规定。 Where the effectiveness of an international application in China has been terminated, the provisions in Paragraph 2 of Article 7 of these Rules shall not be applied.
- 对侵犯注册商标专用权的，被侵权人也可以直接向人民法院起诉。 Where the exclusive right to use a registered trademark has been infringed, the infringee may institute legal proceedings directly with the people's court.
- 转让布图设计专有权的，当事人应当订立书面合同，并向国务院知识产权行政部门登记，由国务院知识产权行政部门予以公告。布图设计专有权的转让自登记之日起生效。 Where the exclusive rights of a layout-design are assigned, the interested parties shall conclude a contract in writing, and record the assigned layout-design with the intellectual property administrative authority under the State Council, which shall publish the recorded assignment. The assignment of the layout-design becomes effective on the date of registration.
- 直接向国务院专利行政部门缴纳费用的，以缴纳当日为缴费日。以邮局汇付方式缴纳费用的，以邮局汇出的邮戳日为缴费日。以银行汇付方式缴纳费用的，以银行实际汇出日为缴费日；但是，自汇出日至国务院专利行政部门收到日超过１５日的，除邮局或者银行出具证明外，以国务院专利行政部门收到日为缴费日。 Where the fees are directly paid to the administrative department for patent under the State Council, the date when the payment was made shall be regarded as the payment date. Where the fees are remitted by post, the date of mailing indicated by the postmark shall be regarded as the payment date. Where the fees are remitted by bank, the date of actual remittance by the bank shall be regarded as the payment date; however, if the period from the remittance date to the date of receipt by the administrative department for patent under the State Council has exceeded 15 days, the date of receipt by the administrative department for patent under the State Council shall be regarded as the payment date unless the post office or the bank has issued an attestation.
- 期满未办理登记手续的，视为放弃取得专利权的权利。 Where the formalities of registration have not been fulfilled at the expiry of the time limit, the applicant shall be deemed to have abandoned his/its right to obtain the patent right.
- 构成犯罪的，依法追究刑事责任。 Where the infringement constitutes a crime, he shall be prosecuted for his criminal liability.
- 侵犯注册商标专用权，未构成犯罪的，工商行政管理部门可以处以罚款。 Where the infringement of the exclusive right to use a registered trademark is not serious enough to constitute a crime, the administrative authority for industry and commerce may impose a fine.
- 涉及实用新型专利的，人民法院或者管理专利工作的部门可以要求专利权人出具由国务院专利行政部门作出的检索报告。 Where the infringement relates to a patent for utility model, the people's court or the administrative authority for patent affairs may ask the patentee to furnish a search report made by the patent administration department under the State Council.
- 侵权人期满不起诉又不停止侵权行为的，国务院知识产权行政部门可以请求人民法院强制执行。 Where the infringer neither institutes legal proceedings, nor stops the infringing act, the intellectual property administrative authority under the State Council may request the People's Court for compulsory enforcement.
- 国际申请在优先权日起１９个月内选定中国并且该选定继续有效的，国际申请的申请人应当在优先权日起３０个月内，向国务院专利行政部门办理国际申请进入中国国家阶段的下列手续： where the international application has selected China within 19 months as of the priority date and the selection continues to be effective, the applicant of the international application shall, within 30 months as of the priority date, fulfill the following formalities for the international application to enter the National Phase in China to the administrative department for patent under the State Council:
- 国际申请以中文以外的文字提出的，应当公布申请文件的中文译文。 where the international application is filed in a language other than Chinese, the Chinese translation of the application documents shall be published.
- 国际局尚未向国务院专利行政部门传送国际申请的，申请人应当提交经确认的国际申请副本。 Where the International Bureau has not transmitted the international application to the administrative department for patent under the State Council, the applicant shall submit a copy of the confirmed international application.
- 需要保密的，由国务院专利行政部门按照保密专利申请处理，并通知申请人。 Where the invention needs to be maintained confidential, the administrative department for patent under the State Council shall deal with the application as one of confidential patent and notify the applicant accordingly.
- 申请专利的发明创造有专利法第二十四条第（一）项或者第（二）项所列情形的，申请人应当在提出专利申请时声明，并自申请日起２个月内，提交有关国际展览会或者学术会议、技术会议的组织单位出具的有关发明创造已经展出或者发表，以及展出或者发表日期的证明文件。 Where the invention-creation in an application for a patent falls under any of the circumstances enumerated in Item (1) or Item (2) of Article 24 of the Patent Law, the applicant shall, when filing the application, make a declaration and, within a time limit of 2 months as of the application date, submit a certificate issued by the entity which organized the international exhibition or academic or technical conference, stating that the invention-creation has been exhibited or published and also submit the certified documents on the date of its exhibition or publication.
- 强制许可涉及的发明创造是半导体技术的，强制许可实施仅限于公共的非商业性使用，或者经司法程序或者行政程序确定为反竞争行为而给予救济的使用。 where the invention-creation involved in the compulsory license is a semi-conducting technology, the compulsory license for exploitation shall be limited to be used for a public and non-commercial purpose, or to be used for the purpose of remedying the anti-competition acts determined in judicial or administrative procedures.
- 集体经济组织、村民委员会或者其负责人作出的决定侵害集体成员合法权益的，受侵害的集体成员可以请求人民法院予以撤销。 Where the legitimate rights and interests of any member of the collective are infringed upon by any decision made by a collective economic organization, villagers' committee or the principle thereof, such member may require the people's court to cancel the decision.
- 申请人在原始提交的国际申请的说明书中已记载生物材料样品保藏事项，但是没有在进入中国国家阶段声明中指明的，应当在办理进入中国国家阶段手续之日起４个月内补正。 Where the matters on the deposit of the sample of the biomaterial have been recorded in the specification of the international application originally filed by the applicant, but have not been stated in the declaration for the entry of the National Phase in China, he/it shall make a rectification within 4 months as of the date when he/it fulfills the formalities for the entry of the National Phase in China.
- 原审查部门根据复审请求人的请求，同意撤销原决定的，专利复审委员会应当据此作出复审决定，并通知复审请求人。 Where the original examination department agrees to revoke its former decision upon the request of the applicant requesting re-examination, the Patent Re-examination Board shall make a re-examination decision accordingly and notify the applicant.
- 不愿协商或者协商不成的，专利权人或者利害关系人可以向人民法院起诉，也可以请求管理专利工作的部门处理。 Where the parties are not willing to consult with each other or where the consultation fails, the patentee or any interested party may institute legal proceedings in the people's court, or request the administrative authority for patent affairs to handle the matter.
- 双方不能达成协议的，由国务院专利行政部门裁决。 Where the parties fail to reach an agreement, the Patent Administration Department Under the State Council?shall adjudicate.
- 当事人向两个以上有管辖权的管理专利工作的部门提出请求的，由最先受理的管理专利工作的部门管辖。 where the party concerned requests two or more of departments for the administration of patent work with the jurisdiction, the dispute shall be handled under the jurisdiction of the department for the administration of patent work that first accepts it.
