Any violator of this Law shall, according to the circumstances of the case, be warned or fined by the competent department of environmental protection administration or another department invested by law with power to conduct environmental supervision and management for any of the following acts: 第三十五条 船舶发生海损事故造成或者可能造成海洋环境重大污染损害的，中华人民共和国港务监督有权强制采取避免或减少这种污染损害的措施。 Article 35. If a vessel is involved in a marine accident which has caused, or is likely to cause, a serious pollution damage to the marine environment, the Harbour Superintendency Administration of the People's Republic of China shall have the power to compel action to avoid or minimize such a pollution damage.???第三十五条本法自1986年7月1日起施行。 Article 35. This Law shall come into force as of July 1, 1986.第三十六条企业事业单位在建设和生产过程中造成水土流失，不进行治理的，可以根据所造成的危害后果处以罚款，或者责令停业治理；对有关责任人员由其所在单位或者上级主管机关给予行政处分。 Article 36 Any enterprise or institution that causes soil erosion in the course of construction or production and fails to carry out rehabilitation may, in light of the harmful consequences thus entailed, be punishable with a fine or be instructed to suspend its business for rehabilitation; the responsible persons concerned sha1l be subjected to administrative sanctions by the unit where they work or by the competent departments at higher levels.第三十六条 违反本法规定，使用不符合技术要求的气象专用技术设备，造成危害的，由有关气象主管机构按照权限责令改正，给予警告，可以并处五万元以下的罚款。 Article 36 Any unit or individual that, in Oviolation of the provisions of this Law, causes harm by employing specialized equipment which does not meet the technical specifications shall be ordered by the relevant competent meteorological department within the limits of its authority to make rectification and be given a disciplinary warning and may also be fined not more than 50 000 yuan.??? 第三十六条? 国务院和国务院有关主管部门批准开办矿山企业矿区范围内已有的集体矿山企业，应当关闭或者到指定的其他地点开采，由矿山建设单位给予合理的补偿，并妥善安置群众生活；也可以按照该矿山企业的统筹安排，实行联合经营。? Article 36 Existing collectively-owned mining enterprises, located within the mining area of a mining enterprise to be established with the approval of the State Council or the relevant competent departments under the State Council, shall be closed down or shall conduct mining in other designated areas. The unit that undertakes to open the mine shall give rational compensation to the said collectively-owned mining enterprises and make appropriate arrangements for the masses involved. Or else, according to its overall arrangement, the mining enterprise may also enter into joint operation with the said collectively-owned mining enterprises.第三十六条 企业用于清洁生产审核和培训的费用，可以列入企业经营成本。 Article 36 Expenses incurred for cleaner production auditing and training may be booked as enterprise operating costs.第三十六条非法进出口野生动物或者其产品的，由海关依照海关法处罚；情节严重、构成犯罪的，依照刑法关于走私罪的规定追究刑事责任。 Article 36 If anyone illegally imports or exports wildlife or the products thereof, he shall be punished by the Customs according to the Customs Law; if the circumstances are serious enough to constitute a crime, he shall be prosecuted for criminal responsibility in accordance with the provisions of the Criminal Law on the crimes of smuggling.第三十六条发生矿山事故，矿山企业必须立即组织抢救，防止事故扩大，减少人员伤亡和财产损失，对伤亡事故必须立即如实报告劳动行政主管部门和管理矿山企业的主管部门。 Article 36 In case an accident occurs in a mine, the mining enterprise concerned must organize rescue work immediately so as to prevent the spreading of the accident and reduce casualties and property losses, and must immediately and truthfully report any accident involving causalities to the competent department of labour administration and the authorities in charge of mining enterprises.第三十六条排放含病原体的污水，必须经过消毒处理；符合国家有关标准后，方准排放。 Article 36 Pathogen-contaminated sewage may be discharged only after it is disinfected to meet the relevant standards of the State.第三十六条各级人民政府应当组织有关部门加强对水库大坝的定期检查和监督管理。 Article 36 People's governments at all levels should organize the relevant departments to intensify the regular inspection, supervision and administration over dams of reservoirs. 第三十六条 县级以上各级人民政府应当组织有关部门根据国家产业政策和节能技术政策，推动符合节能要求的科学、合理的专业化生产。 Article 36 People's governments at or above the county level shall coordinate the efforts of the relevant departments to promote, in accordance with the State's industrial policy and policy for energy conservation technology, scientific and rational specialized production that meets the requirements of energy conservation.第三十六条 预备役军官接到征召的通知后，必须按照规定时间到指定地点报到；由于伤病等原因暂时不能应召的，经县人民武装部核实，并报上一级兵役机关批准，可以暂缓应召。 Article 36 Reserve officers shall report for duty at the designated places within the prescribed time after they have received the notice for call-up; in cases anyone is unable for the time being to respond to the call because of injury, sickness or other reasons, his call-up may be postponed, provided the case has been verified by the people's armed forces department at the county level and approved by the organ of military service at the next higher level. 第三十六条 地震灾区的县级以上地方人民政府应当组织交通、邮电、建设和其他有关部门和单位采取措施，尽快恢复被破坏的交通、通信、供水、排水、供电、供气、输油等工程，并对次生灾害源采取紧急防护措施。 Article 36 The local people's governments at or above the county level in earthquake-stricken areas shall mobilize the traffic, post and telecommunications and construction authorities and other departments or units concerned to take measures to quickly restore the disrupted traffic, communications, water supply, drainage, power, gas and petroleum supply and other facilities, and take urgent protective measures against sources of secondary disasters. 第三十六条 林区木材的经营和监督管理办法，由国务院另行规定。 Article 36 The operation, supervision and administration methods for timber in forest districts shall be separately formulated by the State Council. 第三十六条国家发展和推广洁净煤技术。 Article 36 The State shall develop and disseminate clean coal technology.第三十六条 建设经过已有的噪声敏感建筑物集中区域的高速公路和城市高架、轻轨道路，有可能造成环境噪声污染的，应当设置声屏障或者采取其他有效的控制环境噪声污染的措施。 Article 36 To build expressways, urban overhead road and light-tract lines that traverse areas where there are concentrated noise-sensitive structures and that might produce environmental noise pollution, sound barriers shall be erected or other effective measures shall be taken to control environmental noise pollution.第三十六条 向大气排放粉尘的排污单位，必须采取除尘措施。 Article 36 Units that discharge dust into the atmosphere must adopt measures to remove such dust. 第三十六条 贮存、运输、处置城市生活垃圾，应当遵守国家有关环境保护和城市环境卫生的规定，防止污染环境。 Article 36 Urban house refuse shall be stored, transported and treated in compliance with the State regulations concerning environmental protection and environmental sanitation in urban areas, thus preventing environmental pollution. 第三十六条 所有船舶均有监视海上污染的义务，如发现违章行为和污染情事，应当立即向就近的港务监报告，渔船也可以向就近的渔政渔港监督管理机构报告。 Article 36. All vessels have the obligation to guard against pollution of the sea. Upon discovering violations of regulations or occurrences of pollution, they shall immediately report them to the nearest harbour superintendency administration; fishing boats may also report such occurrences to the nearest fisheries administration and fishing harbour superintendency agency. 第三十六条 单位之间、个人之间、单位与个人之间发生的水事纠纷，应当通过协商或者调解解决。 Article 36. Any dispute concerning water between units, between individuals or between units and individuals shall be resolved through consultation or mediation.????第三十六条??建设项目的防治污染设施没有建成或者没有达到国家规定的要求，投入生产或者使用的，由批准该建设项目的环境影响报告书的环境保护行政主管部门责令停止生产或者使用，可以并处罚款。 Article 36. When a construction project is commissioned or put to use in circumstances where facilities for the prevention and control of pollution either have not been completed or fail to meet the requirements specified in state provisions, the competent department of environmental protection administration responsible for the approval of the environmental impact statement on the construction project shall order the suspension of its operations or use and may concurrently impose a fine.第三十七条 违反本法规定，安装不符合使用要求的雷电灾害防护装置的，由有关气象主管机构责令改正，给予警告。 Article 37 Any unit or individual that, in violation of the provisions of this Law, installs lightning protection devices which do not meet the operational specifications shall be ordered by the relevant competent meteorological department to make rectification and be given a disciplinary warning.
