When other organizations apply for the cutting license, they shall come up with a document that contains such contents as cutting objective, location, tree species, tree situation, area, stock, approach and reforestation measures.第三十四条 机动车辆在城市市区范围内行驶，机动船舶在城市市区的内河航道航行，铁路机车驶经或者进入城市市区、疗养区时，必须按照规定使用声响装置。 Article 34 When motor vehicles are driven in urban areas, motor vessels are navigated along inland rivers in urban areas, and locomotives are running through or entering urban areas or sanatorium areas, their sound-making apparatus must be used in compliance with regulations.第三十四条 预备役军官有下列情形之一的，应当由县人民武装部注销其预备役军官登记： Article 34 Where reserve officers fall into one of the following circumstances, their registration as reserve officers shall be cancelled by the people's armed forces departments at the county level: 第三十四条 使用供水工程供应的水，应当按照规定向供水单位缴纳水费。 Article 34. Anyone who uses water provided by a water-supply project shall pay a water fee to the supplying unit in accordance with the relevant provisions. 第三十四条 船舶非正常排放油类、油性混合物和其他有害物质，或有毒、含腐蚀性货物落水造成污染时，应当立即采取措施，控制和消除污染，并向就近的港务监督报告，接受调查处理。 Article 34. In case pollution has resulted from an abnormal discharge of oils, oil mixtures or other harmful substances, or from the spilling overboard of noxious or corrosive goods, the vessel concerned shall immediately take measures to control and eliminate such pollution and shall report the matter to the nearest harbour superintendency administration for investigation and settlement.????第三十四条??任何单位不得将产生严重污染的生产设备转移给没有污染防治能力的单位使用。 Article 34. The department of fishery administration under the State Council shall, in accordance with this Law, formulate rules for its implementation, which shall go into effect after being submitted to and approved by the State Council. 第三十五条 任何单位和个人应当遵守城市人民政府环境卫生行政主管部门的规定，在指定的地点倾倒、堆放城市生活垃圾，不得随意扔撒或者堆放。 Article 35 All units and individuals shall, in compliance with the regulations of the competent administrative department of environmental sanitation of an urban people's government, dump and pile up house refuse in designated places, and may not discard it or pile it up anywhere else at will.第三十五条 违反本法规定，有下列行为之一的，由有关气象主管机构按照权限责令停止违法行为，限期恢复原状或者采取其他补救措施，可以并处五万元以下的罚款； Article 35 Any unit or individual that, in violation of the provision of this Law, commits one of the following acts shall be ordered by the relevant competent meteorological department within the limits of its authority to discontinue the violation and put the facilities and environs back to their former state or take other remedial measures within a time limit, and it/he may be fined not more than 50 000 yuan.第三十五条违反本法规定，出售、收购、运输、携带国家或者地方重点保护野生动物或者其产品的，由工商行政管理部门没收实物和违法所得，可以并处罚款。 Article 35 If anyone, in violation of the provisions of this Law, sells, purchases, transports or carries wildlife under special state or local protection or the products thereof, such wildlife and products and his unlawful income shall be confiscated by the administrative authority for industry and commerce and he may concurrently be fined.第三十五条在林区采伐林木，不采取水土保持措施，造成严重水土流失的，由水行政主管部门报请县级以上人民政府决定责令限期改正、采取补救措施，处以罚款。 Article 35 In the case of tree-felling in forest areas without adopting water and soil conservation measures, thus causing serious soil erosion, the department of water administration shall report thereon to the people's government at or above the county level for a decision to order a rectification within a fixed period of time and the adoption of remedial measures, and shall also impose a fine.第三十五条 省、自治区、直辖市人民政府环境保护行政主管部门可以委托已取得公安机关资质认定的承担机动车年检的单位，按照规范对机动车排气污染进行年度检测。 Article 35 The administrative departments of environmental protection under the people's governments of provinces, autonomous regions and municipalities directly under the Central Government may authorize the annual testing of pollution by motor-vehicle's exhaust fume in accordance with the relevant regulations. The Central Government may authorize the units undertaking annual test of motor-vehicles whose qualifications have been recognized by the public security authorities to conduct these tests. 第三十五条 在国务院和省、自治区、直辖市人民政府安排的科学研究资金中应当安排节能资金，用于先进节能技术研究。 Article 35 The funds allocated by the State Council and the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government for scientific research shall include funds for conserving energy, which shall be used for research in advanced technology for energy conservation. 第三十五条 地震灾区的县级以上地方人民政府应当组织民政和其他有关部门和单位，迅速设置避难场所和救济物资供应点，提供救济物品，妥善安排灾民生活，做好灾民的转移和安置工作。 Article 35 The local people's governments at or above the county level in earthquake-stricken areas shall mobilize the civil affairs authorities and other departments or units concerned to lose no time in setting up shelters and stations for the supply of relief goods and materials, make proper arrangements for the daily life of the victims, and help them to evacuate and settle down in new places.第三十五条 县人民武装部必须按照规定对在本行政区域内登记的预备役军官，每年进行一次核对，并逐级统计上报。 Article 35 The people's armed forces departments at the county level shall make annual checks on the registered reserve officers in their respective administrative regions in accordance with the relevant regulations, and the statistics so obtained shall be reported to higher authorities level by level.第三十五条劳动行政主管部门的矿山安全监督人员有权进入矿山企业，在现场检查安全状况；发现有危及职工安全的紧急险情时，应当要求矿山企业立即处理。 Article 35 The personnel in charge of mine safety supervision under the competent department of labour administration are entitled to enter mining enterprises and make on-the-spot inspections on the state of safety; when circumstances of emergency threatening the safety of workers and staff are discovered, they shall demand a prompt action thereof by the mining enterprise involved.第三十五条 城市人民政府公安机关可以根据本地城市市区区域声环境保护的需要，划定禁止机动车辆行驶和禁止其使用声响装置的路段和时间，并向社会公告。 Article 35 The public security organs of municipal people's governments may, in line with the need to protect the local acoustic environment of the urban areas, demarcate no-motor-vehicle or no-horn road sections and hours, and make them known to the public.第三十五条属于国家所有的防洪工程设施，应当按照经批准的设计，在竣工验收前由县级以上人民政府按照国家规定，划定管理和保护范围。 Article 35 The scope of administration and protection of state--owned flood control works should be determined by people's governments at or above the county level according to the state provisions before the completion and acceptance of the projects according to the approved design.??? 第三十五条? 国家对集体矿山企业和个体采矿实行积极扶持、合理规划、正确引导、加强管理的方针，鼓励集体矿山企业开采国家指定范围内的矿产资源，允许个人采挖零星分散资源和只能用作普通建筑材料的砂、石、粘土以及为生活自用采挖少量矿产。? Article 35 The State applies the principles of vigorous support, rational planning, correct guidance and effective administration with regard to collectively-owned mining enterprises and privately-owned mining undertakings. It encourages collectively-owned mining enterprises to mine mineral resources within the areas designated by the State, and permits individuals to mine scattered and dispersed mineral resources, as well as sand, stone and clay that can only be used as ordinary building materials, and small amounts of minerals for their own use in daily life. 第三十五条国家提倡和支持煤矿企业和其他企业发展煤电联产、炼焦、煤化工、煤建材等，进行煤炭的深加工和精加工。 Article 35 The State shall encourage and support coal mining enterprises and other enterprises to produce both coal and electricity, coking coal, coal chemicals and building materials made of coal and engage in deep and fine processing of coal. 第三十五条 采伐林木的单位或者个人，必须按照采伐许可证规定的面积、株数、树种、期限完成更新造林任务，更新造林的面积和株数不得少于采伐的面积和株数。 Article 35 Tree cutting organizations or private individuals shall, in accordance with the area, number of trees, tree species and period of time specified in the cutting license, finish the reforestation task; the area and number of trees in the reforestation shall not be smaller than those cut.第三十五条向水体排放含热废水，应当采取措施，保证水体的水温符合水环境质量标准，防止热污染危害。 Article 35 Where heated waste water is discharged into any water body, measures shall be taken to ensure that the temperature of the water body conforms to the standards for water environment quality, so as to prevent any heat pollution hazard.
