Motor vehicles must be regularly serviced and kept in good repair in order to maintain excellent technical performance and help prevent and control environmental noise pollution.第三十三条 预备役军官因工作调动或者迁居需要变更预备役军官登记地的，应当办理转出手续，并自到达新的工作单位或者居住地之日起三十日内，到所在地的县人民武装部办理转入手续。 Article 33 Reserve officers who need to change the places of their registration as reserve officers due to the transfer of their work or the change of their residence shall go through the procedures of transferring their registration of reserve service out from the original places, and shall, within 30 days from their arrival at the new work units or the new residence, go through the procedures of transferring their registration in at the people's armed forces departments at the county level in the regions where they work or reside. 第三十三条 审核发放采伐许可证的部门，不得超过批准的采伐限额发放采伐许可证。 Article 33 The authorities in charge of examining and issuing cutting licenses shall not issue the cutting licenses in excess of the annual cutting quota. 第三十三条 国家组织实施重大节能科研项目、节能示范工程，提出节能推广项目，引导企业事业单位和个人采用先进的节能工艺、技术、设备和材料。 Article 33 The State coordinates efforts for scientific research of key energy conservation projects and demonstration projects of energy conservation and recommends energy conservation projects for dissemination, providing guidance for enterprises, institutions and individuals to employ advanced techniques, skills, equipment and material for energy conservation.第三十三条在洪泛区、蓄滞洪区内建设非防洪建设项目，应当就洪水对建设项目可能产生的影响和建设项目对防洪可能产生的影响作出评价，编制洪水影响评价报告，提出防御措施。 Article 33 Where a construct ion project not intended for flood control is to be carried out within a flooded area or a flood storage and detention area, the possible impact of floodwater on the construct ion project and the possible impact of the construction project on flood control should be assessed, a flood impact assessment report be provided and precautions be put forward.第三十三条企业事业单位、农业集体经济组织未经县级人民政府水行政主管部门批准，擅自开垦禁止开垦坡度以下、五度以上的荒坡地的，由县级人民政府水行政主管部门责令停止开垦、采取补救措施，可以处以罚款。 Article 33 Where any enterprise, institution, or agricultural collective economic organization, without approva1 of the department of water administration under the people's government at the county leve1, reclaims waste hillsides with a slope of above 5 degrees but under the reclamation-forbidden degrees, the department of water administration under the people's government at the county level shal1order the cessation of the reclamation and the adoption of remedial measures, and may also impose a fine.第三十三条 在用机动车不符合制造当时的在用机动车污染物排放标准的，不得上路行驶。 Article 33 Where motor vehicles currently in use do no meet the standards for pollutants discharge by motor vehicles at the time they are manufactured, they may not be driven on the road. 第三十三条 露天贮存冶炼渣、化工渣、燃煤灰渣、废矿石、尾矿和其他工业固体废物的，应当设置专用的贮存设施、场所。 Article 33 Whoever stores in open air metallurgical slag, residue of chemical industry, cinder of burned coal, ettle, ore tailings or other industrial solid waste shall build special installations and sites for the purpose.第三十三条 对从事清洁生产研究、示范和培训，实施国家清洁生产重点技术改造项目和本法第二十九条规定的自愿削减污染物排放协议中载明的技术改造项目，列入国务院和县级以上地方人民政府同级财政安排的有关技术进步专项资金的扶持范围。 Article 33 With respect to conducting cleaner production research, demonstration projects and training, implementing key national cleaner production technological innovation projects and implementing individual technological innovation projects listed in the voluntary pollutant reduction agreements entered into per the provisions of Article 29 of this Law, the above activities and projects shall fall within the scope of the support parameters of the Special Technological Development Funds set aside by the fiscal management departments of the State Council and its coordinate local people's governments at or above county level. 第三十三条 造船、修船、拆船和打捞船单位，均应备有防止污染器材和设备。进行作业时，应当采取预防措施，防止油类、油性混合物和废弃物污染海域。 Article 33. During operations, preventive measures shall be taken against pollution of the sea by oils, oil mixtures and other wastes.???第三十三条本法规定的行政处罚，由渔业行政主管部门或者其所属的渔政监督管理机构决定。当事人对行政处罚决定不服的，可以在接到通知之日起三十天内，向人民法院起诉；期满不起诉又不履行的由作出处罚决定的机关申请人民法院强制执行。但是，在海上作业的，必须先执行有关处罚决定。 Article 33. The administrative sanctions stipulated in this Law shall be decided by departments of fishery administration or their subordinate fishery superintendency agencies. Any party who refuses to accept the decision on an administrative sanction may file a suit in a people's court within 30 days after receiving notification of the decision. If the party neither files a suit nor complies with the decision within the time limit, the agency that made the decision shall request the people's court to compel execution of the decision. However, a party which is engaged in maritime operations must comply with the sanction before filing a suit.????第三十三条??生产、储存、运输、销售、使用有毒化学物品和含有放射性物质的物品，必须遵守国家有关规定，防止污染环境。 Article 33. The production, storage, transportation, sale and use of toxic chemicals and materials containing radioactive substances must comply with the relevant state provisions so as to prevent environmental pollution.第三十三条 本细则自一九九一年七月一日起施行。 Article 33. This Bylaw shall become effective as from the first day of July of 1991. 第三十三条 新建、扩建、改建的建设项目，需要申请取水许可的，建设单位在报送设计任务书时，应当附有审批取水申请的机关的书面意见。 Article 33. Where it is necessary to apply for a water-drawing license for a new construction project, an extension project or a reconstruction project, the construction unit shall, while submitting the design for the project, enclose written comments from the organ in charge of examining applications for the drawing of water.第三十四条 各级气象主管机构应当组织和城市规划、国家重点建设工程、重大区域经济开发项目和大型太阳能、风能等气候资源开发利用项目进行气候可行性论证。 Article 34 Competent meteorological departments at all levels shall arrange for climatic feasibility studies relating to city planning, key national construction projects, major regional economic development projects and large projects for the exploitation of climatic resources such as solar and wind energy.第三十四条大中城市，重要的铁路、公路干线，大型骨干企业，应当列为防洪重点，确保安全。 Article 34 Flood control work should focus on large and medium--sized cities, trunk lines of major railways and highways as well as large--sized key enterprises and their safety be guaranteed.第三十四条 在依照国家规定设立的中小企业发展基金中，应当根据需要安排适当数额用于支持中小企业实施清洁生产。 Article 34 Funding from the Small- and Medium-Sized Enterprise Development Fund established in accordance with national regulations shall be set aside to support cleaner production for small- and medium-sized enterprises in accordance with their needs.第三十四条违反本法规定，在自然保护区、禁猎区破坏国家或者地方重点保护野生动物主要生息繁衍场所的，由野生动物行政主管部门责令停止破坏行为，限期恢复原状，处以罚款。 Article 34 If anyone, in violation of the provisions of this Law,destroys in nature reserves or areas closed to hunting the main places where wildlife under special state or local protection lives and breeds, he shall be ordered by the department of wildlife administration to stop his destructive acts and restore these places to their original state within a prescribed time limit, and shall be fined.第三十四条在县级以上地方人民政府划定的崩塌滑坡危险区、泥石流易发区范围内取土、挖砂或者采石的，由县级以上地方人民政府水行政主管部门责令停止上述违法行为、采取补救措施，处以罚款。 Article 34 In the case of earth-fetching, sand-digging or quarrying in areas in danger of land-collapsing or land-sliding or where mud-rock flow is liable to occur, as designated by the local people's government at or above the county level, the department of water administration under the people's government at or above the county level shall order the cessation of the above law-breaking acts and the adoption of remedial measures, and shall also impose a fine. 第三十四条 建设工业固体废物贮存、处置的设施、场所，必须符合国务院环境保护行政主管部门规定的环境保护标准。 Article 34 Installations and sites built for storage or treatment of industrial solid waste must comform to the standards for environmental protection prescribed by the competent administrative department of environmental protection under the State Council.第三十四条禁止向水体排放或者倾倒放射性固体废弃物或者含有高放射性和中放射性物质的废水。 Article 34 It is forbidden to discharge or dump radioactive solid wastes or waste water containing any high-or medium-level radioactive substances into any water body.??? 第三十四条? 国务院规定由指定的单位统一收购的矿产品，任何其他单位或者个人不得收购；开采者不得向非指定单位销售。? Article 34 Mineral products to be purchased exclusively by designated units, as prescribed by the State Council, may not be purchased by any other units or individuals; mining enterprises and individuals shall not sell their products to non-designated units.第三十四条县级以上人民政府管理矿山企业的主管部门对矿山安全工作行使下列管理职责： Article 34 The authorities in charge of mining enterprises under the people's governments at or above the county level shall exercise the following functions and responsibilities with respect to the control of safety work in mines: 第三十四条 地震灾区的县级以上地方人民政府应当组织卫生、医药和其他有关部门和单位，做好伤员医疗救护和卫生防疫等工作。 Article 34 The local people's governments at or above the county level in earthquake-stricken areas shall mobilize health and medical institutions and other departments or units concerned to provide medical aid to the wounded and do a good job of sanitation and epidemic prevention.
