- 第—章总则 I. General Rules
- （二）含有第一部分中所列物项的系统应被视为第一部分的物项；但如所含物项与系统不可分或不可复制，且系统为民用用途设计，则该系统应被视为第二部分的物项。 If a Part 1 item is included in a system, that system will also be considered as a Part 1 item, except when the incorporated item cannot be separated, removed or duplicated and the system is designed for civilian uses, where the item will be considered as a Part 2 item
- 有其他违法失职行为，情节严重，构成犯罪的，依照《中华人民共和国刑法》有关规定追究刑事责任。 If he has committed any other act involving violation of the Law and dereliction of duty which is serious enough to constitute a crime, his criminal responsibility shall be investigated according to the relevant provisions of the Criminal Law of the People's Republic of China.
- 当事人没有在合同中订立仲裁条款，事后又没有达成书面仲裁协议的，可以向香港特别行政区法院提起诉讼；但是，当事人对提起诉讼的法院另有约定的除外。 If no arbitration clause is contained in the contract and no written arbitration agreement is reached afterwards, the parties may institute proceedings in a court of the Hong Kong Special Administrative Region, except that the parties agree otherwise as to the court for instituting proceedings.
- 逾期不改正的，由国家军品贸易局报国家军品贸易管理委员会撒销其军品出口经营权。 If no correction is made within the prescribed period of time, the State Bureau of Military Products Trade will request the SACMPT to revoke the military export authorizations granted to such military trading companies.
- 尚不够刑事处罚的，区别不同情况，依照海关法的有关规定处罚，或者由国务院外经贸主管部门给予警告，没收违法所得，处违法所得1倍以上5倍以下的罚款；国务院外经贸主管部门并可以暂停直至撤销其对外贸易经营许可。 if such acts are not serious enough for criminal punishment, by distinguishing different circumstances, they shall be punished in accordance with relevant provisions of the Customs Law, or be given a warning, confiscated of their illegal income, and fined not less than one time but not more than five times the illegal income by the competent foreign economic and trade department of the State Council; the competent foreign economic and trade department of the State Council may concurrently suspend or even revoke the licensing for their foreign trade operations.
- 尚不够刑事处罚的，依照海关法的有关规定处罚；国务院外经贸主管部门并可以撤销其对外贸易经营许可。 if such acts are not serious enough for criminal punishment, they shall be punished in accordance with relevant provisions of the Customs Law, and the competent foreign economic and trade department of the State Council may concurrently revoke the licensing for their foreign trade operations.
- 情节较轻的，参照治安管理处罚条例的处罚规定，由公安机关处以十五日以下拘留。 if the circumstances are relatively minor, the offender shall, with reference to the provisions of the Regulations on Administrative Penalties for Public Security, be punished by the public security organ with a detention of not more than fifteen days.
- 情节严重，构成犯罪的，依法追究刑事责任。 If the circumstances of the case are serious enough to constitute a crime, criminal responsibility shall be investigated in accordance with the Law.
- 国务院有关主管机关认为出境后将对国家安全造成危害或者对国家利益造成重大损失的，不得批准出境。 If the competent department under the State Council holds that the exit of any one of them from the country's territory will endanger state security or cause serious damage to national interests, no approval shall be granted for his exit.
- ??? 如果外国船舶是在中华人民共和国毗连区内，追逐只有在本法第十三条所列有关法律、法规规定的权利受到侵犯时方可进行。 If the foreign ship is within the contiguous zone of the People's Republic of China, the pursuit may be undertaken only when there has been a violation of the rights as provided for in the relevant laws or regulations listed in Article 13 of this Law.
- 香港特别行政区政府如需将香港驻军的部分军事用地用于公共用途，必须经中央人民政府批准；经批准的，香港特别行政区政府应当在中央人民政府同意的地点，为香港驻军重新提供军事用地和军事设施，并负担所有费用。 If the Government of the Hong Kong Special Administrative Region needs for public use any part of the land used for military purposes by the Hong Kong Garrison, it shall seek approval of the Central People's Government; where approval is obtained, the Government of the Hong Kong Special Administrative Region shall make reprovision of land and military facilities for the Hong Kong Garrison at such sites as agreed to by the Central People's Government, and shall bear all the expenses and costs entailed.
- 当事人不愿通过协商、调解解决或者协商、调解不成的，可以依据合同中的仲裁条款或者事后达成的书面仲裁协议，向仲裁机构申请仲裁。 if the parties are unwilling or fail to reach settlement through consultation or mediation, they may submit the dispute to the arbitration agency for arbitration in accordance with the arbitration clause contained in the contract or with a written arbitration agreement reached by the parties afterwards.
- 当事人逾期不履行海关的处罚决定又不申请复议或者向人民法院起诉的，作出处罚决定的海关可以将其保证金没收或者将其被扣留的货物、物品、运输工具变价抵缴，也可以申请人民法院强制执行。 If the person concerned refuses to carry out the Customs decision and fails to apply for a reconsideration of the case to the People's Court within the time-limit, the Customs making the decision may confiscate the deposit of the person concerned, sell off his goods, articles and means of transport detained, or apply to the People's Court for an injunction to enforce the execution of the decision.
- 不愿通过协商、调解解决或者协商、调解不成的，被侵权人可以向法院提起诉讼。 if they are unwilling or fail to reach settlement through consultation or mediation, the infringed party may bring an action in the court.

- 经国务院审核决定的条约、协定的中方草案，经谈判需要作重要改动的，重新报请国务院审核决定。 In case that the Chinese draft of a treaty or agreement already examined and decided upon by the State Council shall have to undergo major modifications as a result of negotiation, the revised draft shall be re-submitted to the State Council for examination and decision.
- 拒绝或者没有能力进行技术处理的，可以予以封存、扣押，依照有关法律、行政法规的规定处理。 in case the organization or individual refuses or is unable to carry out such treatment, the State security organs may seal them up for safekeeping or withhold them, and deal with them according to the provisions of the relevant laws and administrative regulations.
- 保密期限需要延长的，由原确定密级和保密期限的机关、单位或者其上级机关决定。 in cases where it is necessary to extend the period, the matter shall be decided on by the state organ or unit that determined the category of the secret and the period for guarding it or by a superior department.
