- 当事人对裁定不服的，可以在收到裁定书之日起七日内提起上诉。 Where the parties are not satisfied with an order, they may file an appeal within seven days from the date of the receipt of the order.
- 合同当事人没有选择的，适用与合同有最密切联系的国家的法律。 Where the parties to a contract have not made a choice, the law of the country having the closest connection with the contract shall apply.
- 以提供保证金方式进行共同海损担保的，保证金应当交由海损理算师以保管人名义存入银行。 Where the security has been provided in the form of cash deposits, such deposits shall be put in a bank by an average adjuster in the name of a trustee.
- 船舶不符合约定的适航状态或者其他状态而不能正常营运连续满二十四小时的，对因此而损失的营运时间，承租人不付租金，但是上述状态是由承租人造成的除外。 Where the ship has not been operated normally for 24 consecutive hours due to its failure to maintain the seaworthiness or the other conditions as agreed upon, the charterer shall not pay the hire for the operating time so lost, unless such failure was caused by the charterer.
- 船舶尚未修理的，按照牺牲造成的合理贬值计算，但是不得超过估计的修理费。 Where the ship has not been repaired after the sacrifice, the amount of sacrifice thereof shall be calculated on the basis of the reasonable reduced value of ship after the general average sacrifice. Such amount shall not exceed the estimated cost of repair.
- 船舶发生实际全损或者修理费用超过修复后的船舶价值的，共同海损牺牲金额按照该船舶在完好状态下的估计价值，减除不属于共同海损损坏的估计的修理费和该船舶受损后的价值的余额计算。 Where the ship is an actual total loss or where the cost of repair would exceed the value of the ship after the repair, the amount of sacrifice of the ship shall be calculated on the basis of the estimated sound value of the ship, less the estimated cost of repair not allowable as general average, as well as the value of the ship after the damage.
- 承租人将船舶用于运输活动物或者危险货物的，应当事先征得出租人的同意。 Where the ship is to be employed by the charterer to carry live animals or dangerous goods, a prior consent of the shipowner is required.
- 出租人违反前款规定的，承租人有权解除合同，并有权要求赔偿因此遭受的损失。 Where the shipowner acts against the provisions in the preceding paragraph, the charterer shall be entitled to cancel the charter and claim any losses resulting therefrom.
- 出租人违反前款规定，致使承租人遭受损失的，应当负赔偿责任。 Where the shipowner acts against the provisions of the preceding paragraph and thereby causes losses to the charterer, the shipowner shall be liable for compensation.
- 出租人违反前款规定的，承租人有权解除合同。 Where the shipowner acts against the provisions of the preceding paragraph, the charterer is entitled to cancel the charter.
- 出租人违反前款规定的，承租人有权解除合同，并有权要求赔偿因此遭受的损失。 Where the shipowner acts against the provisions of the preceding paragraph, the charterer shall be entitled to cancel the charter and claim any losses resulting therefrom.
- 因未提供约定的货物致使出租人遭受损失的，承租人应当负赔偿责任。 Where the shipowner has suffered losses as a result of the failure of the charterer in providing the intended goods, the charterer shall be liable for compensation.
- 船舶转让发生在航次之的，船舶保险合同至航次终了时解除。 Where the transfer takes place during the voyage, the contract shall be terminated when the voyage ends.
- 受让人对裁定不服的，可以申请复议一次。 Where the transferee is not satisfied with the order, it may apply for reconsideration which could be granted only once.
- 不正当地以低于货物实际价值作为申报价值的，按照实际价值分摊共同海损；在发生共同海损牺牲时，按照申报价值计算牺牲金额。 Where the value of the goods has been improperly declared at a value below its actual value, the contribution to general average shall be made on the basis of their actual value and, where a general average sacrifice has occurred, the amount of sacrifice shall be calculated on the basis of the declared value.
- 没有争议金额、争议金额不明或者当事人对争议金额或其确定方式有不同意见的，由仲裁委员会根据案件复杂程度、涉及利益的大小和范围以及其他因素综合考虑并予以决定是否适用简易程序。 Where there is no amount in dispute, or the amount in dispute is not definite, or the parties hold different opinions on the amount in dispute or the way to count, the Arbitration Commission shall decide by considering the complexity of the case, the sum and scope of the interests concerned and other factors comprehensively whether the Summary Procedure shall apply to the case.
- 船舶未能保持与交船时相同的良好状态的，承租人应当负责修复或者给予赔偿。 Where, upon redelivery, the ship fails to remain in the same good order and condition as it was at the time of delivery, the charterer shall be responsible for rehabilitation or for compensation.
- 因运送期间内的伤害而导致旅客离船后死亡的，自旅客死亡之日起计算，但是此期限自离船之日起不得超过三年； whereas those for the death of passengers that occurred after the disembarkation but resulted from an injury during the period of carriage by sea, counting from the day of the death of the passenger concerned, provided that this period does not exceed three years from the time of disembarkation.
- 事故的当事人和有关人员，在接受主管机关调查时，必须如实提供现场情况和与事故有关的情节。 While being investigated by the competent authority, the parties involved in the accident and relevant personnel must give a truthful account of circumstances at the scene of the accident and other relevant information.
- 船舶碰撞案件，在证据方面有特殊要求的，仲裁委员会或仲裁庭可根据案件需要作必要调整。 With regard to cases of ships collision cases, the Arbitration Commission or the arbitration tribunal may make any necessary adjustment relating to evidentiary issues.
- 对在上述区域内擅自设置， 构筑的设施， 主管机关有权责令其所有人限期搬迁或拆除。 With respect to any installations which have been established or constructed in the above-mentioned areas without authorization, the competent authority shall have the right to order their owners to remove or dismantle the installations within a given period.
- 前款第(五)、(六)项行为构成犯罪的，由司法机关依法追究刑事责任。 With respect to persons whose acts have constituted a crime as specified in paragraphs (5) and (6) of this Article, the judicial organs shall investigate their criminal responsibility according to law.
- 海关对生产企业结转的上述货物按本办法第三章的规定办理。 With respect to the aforesaid goods carried over by the production enterprise, the Customs shall handle the matter in accordance with the provisions in Chapter III of these Measures.
- 在海洋石油开发区内铺设平台间或者平台与单点系泊间的海底电缆、管道，所有者应当在为铺设所进行的路由调查、勘测和施工前，分别将本规定第五条、第六条规定提供的内容，报主管机关备案。 With respect to the laying of submarine cables and pipelines within the marine petroleum development zones between the drilling platforms or between drilling platforms and single berthing points, the owners shall, before the start of the investigations and survey of routes for the laying of submarine cables and pipelines and the start of cable-and pipeline- laying operations, submit a report specifying the contents as provided in Article 5 and Article 6 of these Provisions to the competent authorities for the record.
- 前款规定的各项债权，后发生的先受偿。 With respect to the obligatory rights specified in the preceding paragraph, that arising later shall be satisfied first.
