- 但是，托运人不得因行使此种权利而使承运人或者其他托运人遭受损失，并应当偿付由此产生的费用。 provided that the shipper must not exercise this right of disposition in such a way as to prejudice the carrier or other shippers and he must repay any expenses occasioned by the exercise of this right.
- 证明承运人的受雇人、代理人有此种作为或者不作为的，还应当证明该受雇人、代理人是在受雇、代理范围内行事。 provided that, in the case of such act or omission of a servant or agent of the carrier, it is also proved that he was acting within the scope of his employment.
