- 四级地段空置商品住宅的平均售价，由市建设委员会和市物价局核定；在四级地段安置应得的房屋建筑面积，按照本办法第五条、第六条和第七条的规定计算。 The average selling price of unoccupied commodity houses in Grade 4 locality shall be appraised and determined jointly by the Municipal Construction Commission and the Municipal Price Control Bureau; and the construction area required for resettlement in Grade 4 locality shall be computed in accordance with the provisions of Articles 5, 6 and 7 of the present Procedures.
- 开标应当在招标文件规定的时间、地点公开进行。开标后应当按照招标文件规定的评标标准和程序对标书进行评价、比较，在具备相应资质条件的投标者中，择优选定中标者。 The bids shall be opened at the time and place specified in the tender document, after which the bids shall be evaluated and compared in accordance with the evaluation standards and procedures specified by the tender documents. Successful bidder shall be selected among the bidders with appropriate qualifications based on their merits.

If the certifying documents and title deeds are prepared in foreign language, notarized and verified translations in the Chinese language must be attached thereto.
- 建设行政主管部门应当自收到申请之日起十五日内，对符合条件的申请颁发施工许可证。 The competent construction administrative departments shall issue construction licenses to qualified applicants within 15 days from the date of receipt of applications.
- 国务院建设行政主管部门在收到征求意见函之日起30日内提出意见。 The construction administration department of the State Council shall provide its opinion in writing within 30 days of receiving the request.
- 工程监理单位应当根据建设单位的委托，客观、公正地执行监理任务。 The construction supervising units shall carry out construction supervision in an objective and fair manner in accordance with the entrustment by the project owners.
- 工程监理单位与被监理工程的承包单位以及建筑材料、建筑构配件和设备供应单位不得有隶属关系或者其他利害关系。 The construction supervising units shall not have subordinate relations with or other stakes in the contracting units under supervision and the suppliers of building materials, components and equipment.
- 工程监理单位不得转让工程监理业务。 The construction supervising units shall not transfer the supervising business.
- 发包方和承包方应当订立承包合同，约定双方的权利和义务。土地承包经营的期限由承包合同约定。承包经营土地的单位和个人，有保护和按照承包合同约定的用途合理利用土地的义务。 The contractees and contractors should sign land use contracts to define each other's rights and obligations. The contraced term for operation is to be agreed upon in the land use contracts. Contractors for the land operation are obliged to protect and use the land rationally according to the usages specified in the contracts.
- 承包单位有前款规定的违法行为的，对因转包工程或者违法分包的工程不符合规定的质量标准造成的损失，与接受转包或者分包的单位承担连带赔偿责任。 The contractor which has violated the above clause and the subcontractor shall assume the associate liabilities for the losses incurred from the sub-par quality of the project due to subcontracting.
- 互换的新房成本价，由市建设委员会和市物价局参照本市公有住宅出售的成本价制定。 The cost price of the newly-built house for exchange shall be set jointly by the Municipal Construction Commission and the Municipal Price Control Bureau by reference to the cost price for the sale of publicly-owned residential houses.
- 拆迁公有居住房屋，可以采取下列安置方式： The following ways of resettlement may be used for the demolition of publicly-owned residential houses:
- 省、自治区、直辖市人民政府对外贸易经济行政主管部门在授权范围内负责外商投资建筑业企业设立的管理工作；省、自治区、直辖市人民政府建设行政主管部门按照本规定负责本行政区域内的外商投资建筑业企业资质的管理工作。 The foreign trade and economic cooperation administration departments of the people’s government of provinces, autonomous regions or directly administered municipalities shall be responsible for the administration of the establishment of foreign-invested construction enterprises within their authorised jurisdiction; the construction administration departments of the people’s government of the provinces, or autonomous regions or directly administered municipalities shall, in accordance with these Regulations, be responsible for the administration of qualifications of foreign–invested construction enterprises within their administrative regions.
- 前款所列房屋地段，由市房屋土地管理局另行划定。 The grades of the locality of the house listed in the preceding paragraph shall be defined separately by the Municipal Housing and Land Administration.
- 县级以上人民政府土地行政主管部门会同同级有关部门进行土地调查。土地所有者或者使用者应当配合调查，并提供有关资料。 The land administrative departments of the people's governments at and above the county level shall carry out land surveys together with related departments at the same level. Land owners or users should provide good cooperation and necessary data and materials required.
- 在城市规划区内、村庄和集镇规划区内，城市和村庄、集镇建设用地应当符合城市规划、村庄和集镇规划。 The land for construction purposes in cities, villages and market towns within the planned areas of cities, villages and market towns shall conform to the city planning and the planning of villages and market towns.
- 前款土地使用者应当依照《中华人民共和国城镇土地使用税暂行条例》的规定缴纳土地使用税。 The land user referred to in the preceding paragraph shall pay tax for the use of the land in accordance with the provisions of the Interim Regulations of the People's Republic of China Concerning the Tax for the Use of the Land in the Urban Areas.

- 外商投资建筑业企业在中华人民共和国境内的合法经营活动及合法权益受中国法律、法规、规章的保护。 The lawful operation of foreign-invested construction enterprises and their legal rights and interests within the territory of the People’s Republic of China shall be protected by Chinese laws, regulations and rules.
- 租赁合同不得违背国家法律、法规和土地使用权出让合同的规定。 The lease contract shall not run counter to the laws and regulations of the State or the stipulations of the contract for assigning the right to the use of the land.
- 建筑施工企业的法定代表人对本企业的安全生产负责。 The legal representative of a construction enterprise is responsible for the safety in operation of this enterprise.
- 建筑施工企业的管理人员违章指挥、强令职工冒险作业，因而发生重大伤亡事故或者造成其他严重后果的，依法追究刑事责任。 The management of a construction enterprise who gives directions in violation of regulations and forces workers to take risks in performing operations shall be prosecuted for criminal liabilities for major casualties or other serious consequences.
