- 第四条上海市公用事业管理局（以下简称市公用局）是本市燃气行政主管部门，负责本条例的组织实施； Article 4 The Shanghai Municipal Public Utilities Administration (hereinafter called the MPUA)is the competent department of this municipality in fuel gas administration, responsible for putting these Regulations into implementation.
- 第四条 国家实行严格控制大城市规模、合理发展中等城市和小城市的方针，促进生产力和人口的合理布局。 Article 4. The state shall guide itself by the principle of strictly controlling the size of large cities and developing medium-sized and small cities to an appropriate extent in the interest of a rational distribution of productive forces and of the population.
- 第四十条燃气生产企业、燃气销售企业应当建立燃气设施巡查制度，并制定燃气事故的应急处理预案，报市公用局备案。 Article 40 The fuel gas producing and selling enterprises shall institute the system of inspection rounds of fuel gas facilities and work out preplanning for contingency treatment of fuel gas accidents and report to the MPUA for record.
- 第四十条 在城市规划区内，未取得建设工程规划许可证件或者违反建设工程规划许可证件的规定进行建设，严重影响城市规划的，由县级以上地方人民政府城市规划行政主管部门责令停止建设，限期拆除或者没收违法建筑物、构筑物或者其他设施； Article 40. Construction which is undertaken within a planned urban area without a permit for a planned construction project or not in line with the requirements stated in the permit and which seriously affects city planning shall, by order of the competent department of city planning administration of the local people's government at or above the county level, be suspended, removed within a prescribed period of time or be punishable by the confiscation of illegal buildings, structures or facilities;
- 第四十一条燃气事故造成人员伤亡、财产损失的，由公安部门、市燃气管理处或者县（区）燃气行政管理部门按照各自职责勘查事故现场，调查取证，并确定事故原因和责任。 Article 41 If there are casualties and property losses caused by fuel gas accidents, the public security department, the MFGMO or county / district fuel gas administrative department shall inspect the accident spot, investigate and collect evidence, and determine the cause and responsibility of the accident according to their respective functions.
- 第四十一条 对未取得建设工程规划许可证件或者违反建设工程规划许可证件的规定进行建设的单位的有关责任人员，可以由其所在单位或者上级主管机关给予行政处分。 Article 41. A person responsible for constructing a project without a permit for a planned construction project or not in line with the requirements in the permit may be given administrative sanction by the organization where he works or by the competent authority at a higher level.
- 第四十二条燃气事故的有关当事人按照下列规定承担损害责任： Article 42 The party concerned of the fuel gas accident shall be liable for the damage according to the following provisions:
- 第四十二条 当事人对行政处罚决定不服的，可以在接到处罚通知之日起十五日内，向作出处罚决定的机关的上一级机关申请复议；对复议决定不服的，可以在接到复议决定之日起十五日内，直接向人民法院起诉。 Article 42. A party refusing to accept the decision on administrative sanction may, within 15 days of receiving the notification on such a decision, apply for reconsideration to the department next higher to the authorities that decided on the sanction; if the party refuses to accept the decision of reconsideration, it may, within 15 days of receiving the reconsideration decision, bring a suit before a people's court.
- 第四十三条违反本条例规定，有下列情形之一的，由市公用局责令限期改正，并可予以处罚： Article 43 Any of the following acts in violation of the provisions of these Regulations shall be rectified within the time limit by order of the MPUA and may be subject to punishments:
- 第四十三条 城市规划行政主管部门工作人员中玩忽职守、滥用职权、拘私舞弊的，由其所在单位或者上级主管机犬给予行政处分：构成犯罪的，依法追究刑事责任。 Article 43. Any member of a competent department of city planning administration who neglects his duty, abuses his power or engages in malpractices for personal gains shall be given administrative sanction by the unit to which he belongs or by the competent higher authorities; if his act constitutes a crime, he shall be investigated for criminal responsibility according to law.
- 第四十四条违反本条例第十七条第三款，第十八条第一款、第二款，第十九条第一款，第二十三条，第二十六条第二款，第四十条第二款规定的，由市公用局或者县（区）燃气行政管理部门责令限期改正，并可处以一千元以上五万元以下罚款； Article 44 Violation of the provisions of Article 17 , Section 3, Article 18 , Section 1,2, Article 19 , Section 1, Article 23, Article 26 , Section 2, and Article 40 , Section 2 of these Regulations shall be rectified within the time limit by order of the MPUA or county / district fuel gas administrative department and may be imposed a fine of not less than RMB 1,000 yuan and not more than RMB 50,000 yuan.
- 第四十四条 未设镇建制的工矿区的居民点，参照本法执行。 Article 44. This Law may be referred to for a residents' community in an industrial or mining district without the administrative status of a town.
- 第四十五条违反本条例规定，有下列行为之一的，由市燃气管理处责令限期改正，并可予以处罚： Article 45 Any of the following acts in violation of provisions of these Regulations shall be rectified within the time limit by order of the MFGMO and may be subject to punishments:
- 第四十五条 国务院城市规划行政主管部门根据本法制定实施条例，报国务院批准后施行。 Article 45. Rules for the implementation of this Law shall be formulated, pursuant to this Law, by the competent department of city planning administration under the State Council, and shall be implemented after they are submitted to and approved by the State Council.
- 第四十六条违反本条例规定，有下列行为之一的，由市燃气管理处或者县（区）燃气行政管理部门责令限期改正，并可予以处罚： Article 46 Any of the following acts in violation of provisions of these Regulations shall be rectified within the time limit by order of the MFGMO or the county / district fuel gas administrative department and may be subject to punishments:
- 第四十六条 本法自1990年4月1日起施行。国务院发布的《城市规划条例》同时废止。 Article 46. This Law shall enter into force as of April 1, 1990. The Regulations on City Planning promulgated by the State Council shall be abrogated therefrom.
- 第四十七条对违反燃气管理的行为，除本条例已规定处罚的外，其他有关法律、法规规定应当予以处罚的，由有关行政管理部门依法予以处罚；构成犯罪的，依法追究刑事责任。 Article 47 In addition to the punishments stipulated by these Regulations for any violation of fuel gas management, there are other punishments stipulated by relevant laws and regulations, the relevant administrative department shall enforce the punishments according to law . If the wrong constitutes a crime, the party involved shall be prosecuted for his/her criminal liability according to law.
- 第四十八条市公用局、市燃气管理处或者县（区）燃气行政管理部门违反本条例规定，越权审批或者违法审批的，由上级主管机关责令纠正或者予以撤销； Article 48 If the MPUA, the MFGMO or the county / district fuel gas administrative department violates the provisions of these Regulations, giving examination and approval illegally or beyond its jurisdiction, the superior competent organ shall order correction or revocation.
- 第四十九条市公用局、市燃气管理处或者县（区）燃气行政管理部门的工作人员玩忽职守、滥用职权、徇私舞弊的，由其所在单位或者上级主管部门给予行政处分；构成犯罪的，依法追究刑事责任。 Article 49 The working staff of the MPUA, the MFGMO, or the county / district fuel gas administrative department that commit dereliction, abuse power and malpractice shall be given disciplinary sanction by their work unit or the superior competent department. If the irregularities constitute a crime, the wrong- doer shall be prosecuted for his/her criminal liability according to law.
- 第五条本市普及燃气使用，推广清洁能源，促进燃气科技进步，保护和改善大气环境。 Article 5 This municipality shall popularize the use of fuel gas, promote clean energy sources, accelerate the progress of fuel gas science and technology, and protect and improve the atmospheric environment.
- 第五条 城市规划必须符合我国国情，正确处理近期建设和远景发展的关系。 Article 5. City planning must suit the specific conditions of our country and embody a correct handling of the relationship between short-term and long-term development.
- 第五十条当事人对市公用局、市燃气管理处或者县（区）燃气行政管理部门的具体行政行为不服的，可以依照《行政复议条例》或者《中华人民共和国行政诉讼法》的规定，申请复议或者提起诉讼。 Article 50 The party concerned, who disagrees with the specific administrative act of the MPUA, the MFGMO or the county / district fuel gas administrative department, may apply for review or take legal action according to the provisions of the Regulations on Administrative Review or the Administrative Litigation Law of the People’s Republic of China.
- 第五十一条本条例中有关用语的含义： Article 51 The definitions of relevant terms used in these Regulations are as follows:
- 第五十二条本条例施行前已经设立的燃气生产企业、燃气销售企业和燃气供气站点，应当在本条例施行后规定的期限内，向市公用局或者市燃气管理处办理资质申请或者供气许可。 Article 52 The fuel gas producing and selling enterprises and fuel gas supply stations already established before the implementation of these Regulations shall file applications for qualification certificates or gas supply licenses to the MPUA or the MFGMO within the prescribed time limit after the implementation of these Regulations.
- 第五十三条本条例自1999年5月1日起施行。 Article 53 These Regulations shall become effective on May 1, 1999.
