- 建设单位或者个人在取得建设用地规划许可证后，方可向县级以上地方人民政府土地管理部门申请用地，经县级以上人民政府审查批准后，由土地管理部门划拨土地。 Only after acquiring the permit for the planned use of land for construction, may the unit or individual undertaking construction apply for the use of land to the land administration department of the local people's government at or above the county level. After the application is examined and approved by the people's government at or above the county level, land shall be allocated by the department of land administration.
