- 第二十八条 城市规划经批难后，城市人民政府应当公布。 Article 28. The plan for a city shall be announced by the people's government of the city after it is approved.

- 第三条本条例适用于本市行政区域内燃气发展的规划，燃气工程的建设，燃气的生产、销售、使用，燃气设施的保护，燃气器具的生产、销售、安装、维修，以及相关的管理活动。 Article 3 These Regulations apply to the planning of fuel gas development, the construction of fuel gas projects, the production, sales, and use of fuel gas, the protection of fuel gas facilities, the production, sales, installation and maintenance of fuel gas appliances, and related managerial activities in the administrative areas of this municipality.
- 第三条 本法所称城市，是指国家按行政建制设立的直辖市、市、镇。 Article 3. The term "" city "" used in this Law applies to a municipality directly under the Central Government, a city or a town established as one of the administrative divisions of the state.
- 第三十条本市生产燃气器具，应当取得产品生产许可证或者准产证。 Article 30 Fuel gas appliances produced in this municipality shall have production licenses or permits for products.
- 第三十条 城市规划区内的建设工程的选址和布局必须符合城市规划。设计任务书报请批准时，必须附有城市规划行政主管部门的选址意见书。 Article 30. The location and layout of construction projects within a planned urban area must conform to the plan for a city. The design programme submitted for approval must be accompanied by the statement of opinion on the location issued by the competent department of city planning administration.
- 第三十一条在本市销售的燃气器具，应当经市燃气管理处审核后，列入《上海市燃气器具产品准许销售目录》（以下简称《准许销售目录》）。 Article 31 Fuel gas appliances sold in this municipality shall be listed in the Shanghai Municipality’s Permitted Sales Catalogue of Fuel Gas Appliances Products (hereinafter called the Permitted Sales Catalogue) after examination and verification by the MFGMO.
- 第三十—条 在城市规划区内进行建设需要申请用地的，必须持国家批准建设项目的有关文件，向城市规划行政主管部门申请定点，由城市规划行政主管部门核定其用地位置和界限，提供规划设计条件，核发建设用地规划许可证。 Article 31. When applying for the use of land for a construction project in a planned urban area, the unit or individual undertaking construction must produce documents stating the approval of the project by the relevant government authorities and apply to the competent department of city planning administration for the determination of a location for the construction project. The competent department of city planning administration shall determine the site and its boundary, provide the facilities for planning and designing, and issue a permit for the planned use of land for construction.
- 第三十二条燃气器具的安装单位和安装人员应当经市燃气管理处审核合格后，方可从事安装业务。 Article 32 The installation units and installers of fuel gas appliances shall pass the examination of the MFGMO before having permission to engage in installation business.
- 第三十二条 在城市规划区内新建、扩建和改建建筑物、构筑物、道路、管线和其他工程设施，必须持有关批准文件向城市规划行政主管部门提出申请，由城市规划行政主管部门根据城市规划提出的规划设计要求，核发建设工程规划许可证件。 Article 32. For the construction of a new building, structure, road, pipeline and cable or any other engineering works, its extension or its alteration within a planned urban area, application shall be submitted to the competent department of the city planning administration together with the related documents of approval. The competent department of city planning administration shall issue a permit for a planned construction project according to the planning and design requirements defined in the plan for the city.
- 第三十三条燃气销售企业应当根据用户要求，对已经安装的燃气器具的安全使用性能进行检测，在检测过程中发现燃气器具安装质量不符合规定要求的，应当及时检修。 Article 33 The fuel gas selling enterprise shall test the safe use property of the fuel gas appliances already installed at the user’s request, and shall make timely repairs upon discovering the installation quality of fuel gas appliances below the set requirements in the course of test.
- 第三十三条 在城市规划区内进行临时建设，必须在批准的使用期限内拆除。 Article 33. A temporary structure erected within a planned urban area must be demolished within the approved period of time for its use.
- 第三十四条燃气器具的生产企业、销售企业应当设立或者指定产品维修站点，向用户提供维修服务。 Article 34 The fuel gas producing and selling enterprises shall set up or designate product service stations to provide users with maintenance service.
- 第三十四条 任何单位和个人必须服从城市人民政府根据城市规划作出的调整用地决定。 Article 34. All units and individuals must obey the decisions on readjustments in the use of land made by the people's government of a city according to the plan for the city.
- 第三十五条燃气销售企业应当在重要的燃气设施所在地，设置醒目、统一的安全识别标志。 Article 35 The fuel gas selling enterprise shall place conspicuous and uniform safety signs at the site of important fuel gas facilities.
- 第三十五条 任何单位和个人不得占用道路、广场、绿地、高压供电走廊和压占地下管线进行建设。 Article 35. No unit or individual may undertake construction on a road or a public square, in a green space, in a high-voltage power supply corridor, or by cutting into the space for underground pipelines and cables.
- 第三十六条在燃气设施的安全保护范围内，禁止从事下列活动： Article 36 The following activities in the safety protection range of fuel gas facilities are forbidden:
- 第三十六条 在城市规划区内进行挖取砂石、土方等动，须经有关主管部门批准，不得破坏城市环境，影响城市活规划的实施。 Article 36. The excavation of sand and gravel and of earth within a planned urban area shall be approved by the competent administrative authorities. No such activity may cause damage to the urban environment or produce a negative effect on city planning.
- 第三十七条在燃气输配管道的上下或者两侧埋设其他地下管线的，应当符合有关技术标准和规范，并遵守管线工程规划和施工管理的有关规定。 Article 37 The laying of other underground pipelines over and below or on either side of the transmission and distribution pipelines of fuel gas shall conform to related technical standards and norms, and meet the relevant provisions on pipeline project planning and construction performing management..
- 第三十七条 城市规划行政主管部门有权对城市规划区内的建设工程是否符合规划要求进行检查。 Article 37. The competent department of city planning administration shall be empowered to inspect the construction projects in a planned urban area to see if they conform to the requirements of the plan for a city.
- 第三十八条用户需改装、迁移或者拆除燃气计量表出口后的管道及其附属设施的，应当委托具有资质的燃气器具安装单位或者燃气销售企业实施。 Article 38 The users in need of refitting, removing or dismantling the pipeline and additional facilities behind the outlet of fuel gas measuring meter shall entrust the qualified fuel gas installation unit or fuel gas selling enterprise to carry out the work.
- 第三十八条 城市规划行政主管部门可以参加城市规划区内重要建设工程的竣工验收。 Article 38. The competent department of city planning administration may participate in the checking and acceptance of important development projects within a planned urban area.
- 第三十九条燃气销售企业选用的燃气贮罐、气瓶和调压器应当符合规定的标准，并按照压力容器管理的有关规定定期检修和更新。 Article 39 The fuel gas storage tank, cylinder and pressure regulator chosen by the fuel gas selling enterprise shall conform to the required standard, and shall be serviced and renewed periodically according to the relevant regulations on the management of pressure vessels.
- 第三十九条 在城市规划区内，未取得建设用地规划许可证而取得建设用地批准文件、占用土地的，批推文件无效，占用的土地由县级以上人民政府责令退回。 Article 39. If, within a planned urban area, land is occupied and used after the acquisition of documents of approval for the use of land for construction but without the acquisition of a permit for the planned use of land for construction, such documents of approval shall be declared invalid, and the land occupied shall be returned by order of a people's government at or above the county level.
