- 中国单位或者个人可以根据中华人民共和国参加的有关国际条约提出专利国际申请。 Any Chinese entity or individual may file an international application for patent in accordance with any international treaty concerned to which China is party.
- 专利权人与他人订立的专利实施许可合同，应当自合同生效之日起３个月内向国务院专利行政部门备案。 Any contract on the license for use of a patent concluded between the patent holder and another party shall, within 3 months as of the date when the contract entered into force, be submitted to the administrative department for patent under the State Council for record.

- 企业、事业单位和个体工商业者，对其提供的服务项目，需要取得商标专用权的，应当向商标局申请服务商标注册。 Any enterprise, institution, or individual producer or trader, intending to acquire the exclusive right to use a service mark for the services provided by it or him, shall file an application for the registration of the service mark with the Trademark Office.
- 外国人创作的布图设计，其创作者所属国同中国签订有关布图设计保护协议或者与中国共同参加有关布图设计保护国际条约的，依照本条例享有布图设计专有权。 Any foreign inventor of a layout-design who is from a country which has concluded an agreement on the protection of layout-designs with China or which has acceded, with China, to an international treaty on the protection of layout-design shall, according to the Regulations, enjoys the exclusive right in the layout-design he or it invents.

- 中国集体所有制单位和个人的发明专利，对国家利益或者公共利益具有重大意义，需要推广应用的，参照前款规定办理。 Any patent for invention belonging to a Chinese individual or an entity under collective ownership, which is of great significance to the interest of the State or to the public interest and is in need of spreading and application, may be treated alike by making reference to the provisions of the preceding paragraph.
- 为生产经营目的使用或者销售不知道是未经专利权人许可而制造并售出的专利产品或者依照专利方法直接获得的产品，能证明其产品合法来源的，不承担赔偿责任。 Any person who, for production and business purposes, uses or sells a patented product or a product that was directly obtained by using a patented process, without knowing that it was made and sold without the authorization of the patentee, shall not be liable to compensate for the damage of the patentee if he can? prove that he obtains the product from a legitimate source.
- 在完成发明创造过程中，只负责组织工作的人、为物质技术条件的利用提供方便的人或者从事其他辅助工作的人，不是发明人或者设计人。 Any person who, in the process of accomplishing the invention-creation, is responsible only for organizational work, or who offers facilities for the use of material resources, or who takes part in other auxiliary functions, shall not be an inventor or designer.
- 全国重点文物保护单位的迁移、或者拆除，由省、自治区、直辖市人民政府报国务院决定。迁移、拆除所需费用和劳动力由建设单位列入投资计划和劳动计划。 Any removal or dismantling involving a major site to be protected at the national level shall be referred to the State Council by the people's government of a province, an autonomous region or a municipality directly under the Central Government for decision. The expenses and workforce required for the removal or dismantling shall be included in the investment and labour plans of the construction unit.
- 因建设工程和特别需要而必须对文物保护单位进行迁移或者拆除的，应根据文物保护单位的级别，经该级人民政府和上一级文化行政管理部门同意。 Any removal or dismantling involving a site to be protected for its historical and cultural value, if considered specially necessary for a project, shall be agreed to by the people's government at the same level as the site itself and by the department for cultural administration at the next higher level.
- 续展注册经核准后，予以公告。 Any renewal of registration shall be published after it has been approved.
- 以国务院专利行政部门规定的其他形式申请专利的，应当符合规定的要求。 Anyone who applies for a patent in any other form provided by the administrative department for patent under the State Council shall comply with the provided requirements.
- 请求作出实用新型专利检索报告的，应当提交请求书，并指明实用新型专利的专利号。每项请求应当限于一项实用新型专利。 Anyone who makes a request for the retrieval report on the patent for utility model shall submit the written request, and designate the patent number of the patent for utility model. Such requests shall be limited to one for each patent for utility model.
- 请求强制许可的，应当向国务院专利行政部门提交强制许可请求书，说明理由并附具有关证明文件各一式两份。 Anyone who requests a compulsory license shall submit to the administrative department for patent under the State Council a written request for compulsory license and state the reasons therefor, together with relevant supporting documents. The written request and the supporting documents shall all be prepared in duplicate respectively.
