- （一）没有按照规定缴纳年费的； (1) where an annual fee is not paid as prescribed;
- （１）自行改变注册商标的文字、图形或者其组合的； (1) Where any word, device or their combination of a registered trademark is altered unilaterally (that is, without the required registration);
- （一）是当事人或者其代理人的近亲属的； (1) where he is a close relative of the party concerned or the latter's agent;
- （一）发明或者实用新型专利申请缺少请求书、说明书（实用新型无附图）和权利要求书的，或者外观设计专利申请缺少请求书、图片或者照片的； (1) where the application for a patent for invention or utility model does not contain a written request, a specification (or a specification of utility model without appended drawings) or a patent claim, or the application for a patent for design does not contain a written request, drawings or photographs;
- （一）未使用规定的格式或者填写不符合规定的； (1) where the document is not presented in the provided format or the indications therein are not in conformity with relevant provisions;
- （一）已经要求外国优先权或者本国优先权的； (1) where the right of foreign or domestic priority has already been claimed;
- （１）冒充注册商标的； (1) where the trademark is falsely represented as registered;
- （一）发明专利申请是否明显属于专利法第五条、第二十五条的规定，或者不符合专利法第十八条、第十九条第一款的规定，或者明显不符合专利法第三十一条第一款、第三十三条、本细则第二条第一款、第十八条、第二十条的规定； (1) whether an application for a patent for invention obviously falls under Article 5 or Article 25 of the Patent Law, or is not in conformity with Article 18 or Paragraph 1 of Article 19 of the Patent Law, or is obviously not in conformity with Paragraph 1 of Article 31, Article 33 of the Patent Law, or Paragraph 1 of Article 2, Article 18, Article 20 of these Rules;
- （一）未经许可，在其制造或者销售的产品、产品的包装上标注他人的专利号； (1) without permission, marking the patent number of another person on the product produced or sold by himself/itself or on the package of that product;
- （一）作者或者作者之一，其他著作权人或者著作权人之一是国际著作权条约 成员国的国民或者在该条约的成员国有经常居所的居民的作品； (1) works of which the author or one of the coauthors or the other owner of copyright or one of the coowners of copyright is a national or a permanent resident of a country party to the international copyright treaties;
- （一）文字作品，指小说、诗词、散文、论文等以文字形式表现的作品； (1) Written works are works expressed in writing, such as novels, poems, essays and thesis;
- （一）文字作品； (1) written works;
- （16）以国家战略需求为导向，在生物和医药、信息、新材料、先进制造、先进能源、海洋、资源环境、现代农业、现代交通、航空航天等技术领域超前部署，掌握一批核心技术的专利，支撑我国高技术产业与新兴产业发展。 (16)? We shall, guided by state strategic requirements, make al[]s in technical areas such as biology and medication, information, new materials, advanced manufacturing, advanced energy, ocean, resource environment, modern agriculture, modern transportation, aviation and spaceflight etc. in advance, and hold a batch of patents on core technologies to support the development of high-tech and emerging industries.
- （17）制定和完善与标准有关的政策，规范将专利纳入标准的行为。支持企业、行业组织积极参与国际标准的制定。 (17) We shall formulate and improve policies relevant to standards, regulate behaviors applying standards to patents, and support enterprises and trade organizations to participate in formulation of international standards initiatively.
- （18）完善职务发明制度，建立既有利于激发职务发明人创新积极性，又有利于促进专利技术实施的利益分配机制。 (18) We shall improve the employee invention system and establish an interest share system conductive to stimulating innovative initiatives of employee inventors and promoting application of patent technologies.
- （19）按照授予专利权的条件，完善专利审查程序，提高审查质量。防止非正常专利申请。 (19) We shall perfect patent inspection processes according to conditions for authorization of patent rights and improve qualities of inspection, avoiding abnormal patent applications.
- （二）所引用部分不能构成引用人作品的主要部分或者实质部分； (2) What has been quoted does not form a major or substantial part of the work of the quoter;
- （二）已经确认申请登记中提供的主要信息是不真实的。 (2) When primary information provided during the registration application is acknowledged not to be authentic.
- （二）已经被授予专利权的； (2) where a patent right has been granted;
- （２）违反本法第八条规定的； (2) where any provision of Article 8 of this Law is violated;
- （二）与专利申请或者专利权有利害关系的； (2) where he has an interest in the application for patent or the patent right;
- （二）在规定的学术会议或者技术会议上首次发表的； (2) where it was first made public at a prescribed academic or technological meeting;

- （二）未使用中文的； (2) where the application is not written in Chinese;
