- 第十七条煤炭工业主管部门违反本办法规定，有下列情形之一的，对负有直接责任的主管人员和其他直接责任人员给予行政处分： Article 17 In cases where any department in charge of coal industry commits any of the following acts in violation of the Measures, the directly responsible person in charge and other directly responsible person shall be subject to administrative sanctions:
- 第十七条矿山企业必须对作业场所中的有毒有害物质和井下空气含氧量进行检测，保证符合安全要求。 Article 17 Mining enterprises inspect the poisonous and harmful substances at the work sites and the percentage of oxygen in underground air to ensure that they meet safety requirements.
- 第十七条 产品应当采用易回收利用、易处置或者在环境中易消纳的包装物。 Article 17 Products shall be packaged with materials that are easy to be recycled or treated, or easy to dissolve or be absorbed in the environment.
- 第十七条 对预备役军官应当进行考核。考核工作由预备役军官所在部队或者兵役机关会同地方有关部门，根据国家有关规定，按照职责分工，共同组织实施。考核结果作为任免预备役军官职务的主要依据。 Article 17 Reserve officers shall be appraised. The appraisal shall be organized and conducted by the units in which they serve or by the military service organs in conjunction with local departments concerned in accordance with the relevant regulations of the State and in line with the division of responsibilities. The results of the appraisal shall be taken as the main basis for appointing or removing reserve officers.
- 第十七条国务院环境保护部门会同国务院水利管理部门和有关省级人民政府，可以根据国家确定的重要江河流域水体的使用功能以及有关地区的经济、技术条件，确定该重要江河流域的省界水体适用的水环境质量标准，报国务院批准后施行。 Article 17 The environmental protection department under the State Council may, together with the water conservancy administration department under the State Council and the provincial people's government concerned and in light of the utilization functions determined by the State for water bodies of major river basins as well as the economic and technological conditions of the related regions, establish water environment quality standards applicable to water bodies of such major river basins within the provincial boundaries, and such standards shall be put into practice after being reported to and approved by the State Council.
- 第十七条 新建、扩建、改建建设工程，必须达到抗震设防要求。 Article 17 The projects built, expanded or rebuilt shall meet the requirements for seismic resistance.
- 第十七条 省、自治区、直辖市人民政府环境保护行政主管部门，应当加强对清洁生产实施的监督； Article 17 The relevant departments responsible for environmental protection in the people's governments of the various provinces, autonomous regions and municipalities directly under the central government shall enhance their supervision of the process of implementation of cleaner production.
- 第十七条 国家对落后的耗能过高的用能产品、设备实行淘汰制度。 Article 17 The State applies an elimination system for outdated and highly energy-consuming products and equipment.
- 第十七条 国务院按照城市总体规划、环境保护规划目标和城市大气环境质量状况，划定大气污染防治重点城市。 Article 17 The State Council shall, in accordance with the general plan for urban development, the target of the environment protection plan and the quality of the urban atmospheric environment, designate some cities as key cities for the control of air pollution.
- ??? 第十七条? 国家对国家规划矿区、对国民经济具有重要价值的矿区和国家规定实行保护性开采的特定矿种，实行有计划的开采；未经国务院有关主管部门批准，任何单位和个人不得开采。? Article 17 The State institutes a policy of planned mining with regard to mining areas that are embraced in State plans, mining areas that are of great value to the national economy and the specified minerals of which protective mining is prescribed by the State. Unless approved by the competent department under the State Council, no unit or individual may carry out such mining.
- 第十七条国家鼓励驯养繁殖野生动物。 Article 17 The state shall encourage the domestication and breeding of wildlife.
- 第十七条国家制定优惠政策，支持煤炭工业发展，促进煤矿建设。 Article 17 The State shall formulate preferential policies to support the development of the coal industry and promote the construction of coal mines.
- 第十七条 省、自治区、直辖市人民政府畜牧兽医行政主管部门应当对引进的畜禽遗传资源进行跟踪评价，组织专家对引进的畜禽遗传资源的生产性能、健康状况、适应性以及对生态环境和本地畜禽遗传资源的影响等进行测定、评估，并及时将测定、评估结果报国务院畜牧兽医行政主管部门。 Article 17 The stockbreeding and veterinary administrative department of the People’s Government at the province, autonomous region or municipality directly under the Central Government shall keep track of and evaluate imported livestock or poultry genetic resource, and organize experts to make check and determination on such aspects of imported livestock or poultry genetic resource as production performance, state of health, adaptability and influence on eco-environment and local livestock or poultry genetic resource, and timely submit findings of check and evaluation to stockbreeding and veterinary administrative department of the State Council.
- 第十七条在五度以上坡地上整地造林，抚育幼林，垦复油茶、油桐等经济林木，必须采取水土保持措施，防止水土流失。 Article 17 Water and soil conservation measures must be adopted to prevent soil erosion when preparations for afforestation, tending of young growth, and cultivation of commodity trees such as oil-tea camellia and tung tree are done on hillsides with a slope of above 5 degrees.
- 第十七条 勘探开发海洋石油， 必须配备相应的防污设施和器材， 采取有效的技术措施，防止井喷和漏油事故的发生。 Article 17. In exploring and exploiting offshore oil resources, appropriate anti-pollution facilities and equipment shall be made available, and effective technical measures shall be taken to prevent blowouts or accidents from oil leakage.
- 第十七条 国务院有关部门和地方各级人民政府，应当采取措施推广成型煤和低污染燃烧技术，逐步限制烧散煤。 Article 17. Relevant departments under the State Council, and local People's Governments at the various local levels should take steps to popularize the use of shaped coal and oligosaprobic combustion technology with an eye to gradually limiting the use of smell coals.
- ????第十七条??各级人民政府对具有代表性的各种类型的自然生态系统区域，珍稀、濒危的野生动植物自然分布区域，重要的水源涵养区域，具有重大科学文化价值的地质构造、著名溶洞和化石分布区、冰川、火山、温泉等自然遗迹，以及人文遗迹、古树名木，应当采取措施加以保护，严禁破坏。 Article 17. The people's governments at various levels shall take measures to protect regions representing various types of natural ecological systems, regions with a natural distribution of rare and endangered wild animals and plants, regions where major sources of water are conserved, geological structures of major scientific and cultural value, famous regions where karst caves and fossil deposits are distributed, traces of glaciers, volcanoes and hot springs, traces of human history, and ancient and precious trees. Damage to the above shall be strictly forbidden.
- 第十七条 国家保护和鼓励开发水运资源。在通航或者竹木流放的河流上修建永久性拦河闸坝，建设单位必须同时修建过船、过木设施，或者经国务院授权的部门批准采取其他补救措施，并妥善安排施工和蓄水期间的航运和竹木流放，所需费用由建设单位负担。 Article 17. The state shall protect and encourage the development of water transport resources. When permanent dams and sluice-gates are built on rivers which are navigable or suitable for bamboo and log rafting, the construction unit must at the same time build facilities for the passage of ships and for bamboo and log rafting or, after approval by a department authorized by the State Council, take other remedial measures. The construction unit must also make adequate arrangements for navigation and bamboo and log rafting during the construction period and the initial water-filling period, and bear the expenses incurred thereby.
- ???第十七条在内水、近海从事捕捞业的单位和个人，必须按照捕捞许可证关于作业类型、场所、时限和渔具数量的规定进行作业，并遵守有关保护渔业资源的规定。 Article 17. Units and individuals engaging in inland water and inshore fisheries must conduct their operations in accordance with their licences concerning the types of operation, location, time limits and quantity of fishing gear, and they must also abide by the relevant regulations on protection of fishery resources.
- 第十七条 在保护、管理和建设草原、发展草原畜牧业等方面成绩显著的单位或者个人，由各级人民政府给予精神的或者物质的奖励。 Article 17. Units or individuals that have achieved outstanding success in protecting, managing and developing the grasslands or in developing animal husbandry on the grasslands shall be given commendation or material awards by the local people's governments at various levels.
- ??? 第十八条? 国家规划矿区的范围、对国民经济具有重要价值的矿区的范围、矿山企业矿区的范围依法划定后，由划定矿区范围的主管机关通知有关县级人民政府予以公告。? Article 18 After the limits for the mining areas that are embraced in State plans, the limits for mining areas that are of great value to the national economy, and the limits for mining areas of mining enterprises have been defined according to law, the competent departments that defined the limits of the mining areas shall notify the relevant people's governments at the county level to announce them.
- 第十八条依照本办法第十六条规定取得的罚没收入，全部上缴国库。 Article 18 All revenue from punishment of fine and confiscation under Article 16 of the Measures shall be turned over to the state treasury.
- 第十八条 在境内与境外机构、个人合作研究利用列入畜禽遗传资源保护名录的畜禽遗传资源的单位，应当于每年12月31日前，将合作研究利用畜禽遗传资源的情况报所在地的省、自治区、直辖市人民政府畜牧兽医行政主管部门。 Article 18 Any entity engaging in researching and utilizing livestock or poultry genetic resource included in the protection list within China in cooperation with any foreign institution or individual shall submit the status of cooperative research utilization of livestock or poultry genetic resource to stockbreeding and veterinary administrative department of the People’s Government at its province, autonomous area or municipality directly under the Central Government prior to every year’s December 31, and
- 第十八条猎捕非国家重点保护野生动物的，必须取得狩猎证，并且服从猎捕量限额管理。 Article 18 Anyone who intends to hunt or catch wildlife that is not under special state protection must obtain a hunting license and observe the hunting quota assigned.
- 第十八条 企业可以根据自愿原则，按照国家有关产品质量认证的规定，向国务院产品质量监督管理部门或者国务院产品质量监督管理部门授权的部门认可的认证机构提出用能产品节能质量认证申请； Article 18 Enterprises may, on a voluntary basis and in accordance with the State regulations regarding certification of product quality, apply to the administrative department for supervision over product quality under the State Council or to the certification agencies confirmed by the organs authorized by the said department under the State Council for certifying the quality of their energy-using products in terms of energy conservation.
