- 第十六条 商务部负责制定和实施全国范围内再生资源回收的产业政策、回收标准和回收行业发展规划。 Article 16 Ministry of Commerce is responsible for stipulation and implementation of industrial policies of renewable resources recovery, recovery standards and program of recovery industry development as well.
- 第十六条 在国务院和省、自治区、直辖市人民政府划定的风景名胜区、自然保护区、文物保护单位附近地区和其他需要特别保护的区域内，不得建设污染环境的工业生产设施； Article 16 No industrial production facilities that cause environmental pollution shall be built within scenic spots or places of historical interest, natural reserves, areas close to historical or cultural sites under protection and other places that need special protection, as designated by the State Council or the people's government of provinces, autonomous regions and municipalities directly under the Central Government.
- 第十六条煤炭生产开发规划应当根据国民经济和社会发展的需要制定，并纳入国民经济和社会发展计划。 Article 16 Plans for coal production and development shall be worked out in light of the needs of the national economic and social development and shall be incorporated into the plan for national economic and social development.

- 第十六条 省级以上人民政府管理节能工作的部门，应当会同同级有关部门，对生产过程中耗能较高的产品制定单位产品能耗限额。 Article 16 The administrative department for energy conservation of the people's governments at or above the provincial level shall, together with the relevant departments of the corresponding governments, set quotas for energy consumption per unit product for products which consume excessive amounts of energy in the course of production.
- 第十六条禁止猎捕、杀害国家重点保护野生动物，因科学研究、驯养繁殖、展览或者其他特殊情况，需要捕捉、捕捞国家一级保护野生动物的，必须向国务院野生动物行政主管部门申请特许猎捕证； Article 16 The hunting, catching or killing of wildlife under specialstate protection shall be prohibited. Where the catching or fishing for wildlife under first class state protection is necessary for scientific research, domestication and breeding, exhibition or other special purposes, the unit concerned must apply to the department of wildlife administration under the State Council for a special hunting and catching license;
- 第十六条 各级人民政府应当制定林业长远规划。国有林业企业事业单位和自然保护区，应当根据林业长远规划，编制森林经营方案，报上级主管部门批准后实行。 Article 16 The people's government at various levels shall formulate long-term forestry plans. State-owned forestry enterprises, institutions and natural protection zones shall, according to the long-term forestry plans, formulate their forestry operation programs, which shall be implemented after submission to and approval of the competent authorities at a higher level.
- 第十六条 国家对地震预报实行统一发布制度。 Article 16 The State adopts the practice of unified release of earthquake prediction.
- 第十六条违反本办法规定，有下列情形之一的，由煤炭生产许可证的颁发管理机关或者其授权的县级人民政府负责管理煤炭工业的部门，根据具体情况，分别给予5万元以下的罚款、没收违法所得、责令停止生产或者吊销煤炭生产许可证： Article 16 Those violating provisions of the Measures and coming under any of the following categories shall, according to the circumstances, be imposed on a fine not exceeding 50,000 RMB, confiscated of all illegal gains, ordered to suspend the production, or revoked of the coal production license by the agency for issue and administration of coal production licenses or by the department in charge of coal industry of people’s government at the county level authorized by the former:
- 第十六条 收集、贮存、运输、利用、处置固体废物的单位和个人，必须采取防扬散、防流失、防渗漏或者其他防止污染环境的措施。 Article 16 Units and individuals that collect, store, transport, utilize or treat solid waste must take measures to prevent the scattering, running off, leaking and seeping of solid waste, as well as other measures against environmental pollution.
- 第十六条 产生环境噪声污染的单位，应当采取措施进行治理，并按照国家规定缴纳超标准排污费。 Article 16 Units that produce environmental noise pollution shall take measures to control it and pay fees for excessive emission of such pollution according to the regulations of the State.
- 第十六条 在对外合作研究利用过程中需要更改研究目的和范围、合作期限、知识产权归属、研究成果共享方案或者国家共享惠益方案的，在境内与境外机构、个人合作研究利用列入畜禽遗传资源保护名录的畜禽遗传资源的单位，应当按照原申请程序重新办理审批手续。 Article 16 Where any aspect including purpose and scope of research, cooperation period, affiliation of intellectual property, sharing plan for research results and sharing beneficial plan for countries concerned shall be altered in the course of foreign cooperative research utilization, any entity engaging in researching and utilizing livestock or poultry genetic resource included in the protection list within China in cooperation with any foreign institution or individual shall go through examination and approval formalities afresh in accordance with original application procedure.
- 第十六条省级以上人民政府对实现水污染物达标排放仍不能达到国家规定的水环境质量标准的水体，可以实施重点污染物排放的总量控制制度，并对有排污量削减任务的企业实施该重点污染物排放量的核定制度。具体办法由国务院规定。 Article 16 With regard to water bodies where the standards for water environment quality established by the State still cannot be attained although the discharge of water pollutants has conformed to the discharge standards, the people's governments at or above the provincial level may institute a system for control of the total discharge of major pollutants, and a system for making an estimate before deciding on the quantity of major pollutants to be discharged by an enterprise that is charged with the task of reducing its discharge. Specific measures shall be formulated by the State Council.
- ???第十六条从事内水、近海捕捞业，必须向渔业行政主管部门申请领取捕捞许可证。海洋大型拖网、围网作业的捕捞许可证，由国务院渔业行政主管部门批准发放。 Article 16. Any unit or individual that intends to engage in inland water or inshore fishing must first apply to departments of fishery administration for fishing licences. Licences for using large trawls and purse seines in marine fishing shall be granted upon approval by the department of fishery administration under the State Council.
- 第十六条 加强草原防火工作，贯彻“预防为主，防消结合”的方针，建立防火责任制，制定草原防火制度和公约，规定草原防火期。在草原防火期间，应当采取安全措施，严格管理。发生草原火灾，应当迅速组织群众扑灭，查明火灾原因和损失情况，及时处理。 Article 16. Efforts shall be strengthened to prevent fires on the grasslands, implementing the principle of "" put prevention first and combine prevention with elimination."" A responsibility system for fire prevention shall be instituted. Fire prevention rules and pledges shall be formulated and specific periods shall be designated for fire prevention on the grasslands. During those periods, safety measures shall be adopted and rigorously administered. When a grassland fire breaks out, masses of people should be organized promptly to put it out, the cause of the fire and the losses sustained should be determined through investigation and the case should be handled without delay.
- 第十六条 城市新建工业区、新建住宅区以及老城区成片改造，应当实行热电联供； Article 16. Heating and power supply should be made to combine their operations in newly-constructed urban industrial or residential areas are being constructed, or where large sections of the old city are being renovated;
- 第十六条 海上输油管线，储油设施，应当符合防渗、防漏、防腐蚀的要求，经常保持良好状态，防止漏油事故。 Article 16. Offshore oil pipelines and oil-storage installations shall always be kept in good condition, as required for the prevention of seepage, leakage and corrosion, so as to prevent oil leakage accidents.

- 第十六条 国家鼓励开发利用水能资源。在水能丰富的河流,应当有计划在进行多目标梯级开发。 Article 16. The state shall encourage the development and utilization of hydraulic power potentials. On rivers rich with hydraulic power potentials, multipurpose cascade development shall be effected in a planned way.
- 第十六条 本法自公布之日起施行。 Article 16. This Law shall go into effect as of the date of promulgation.
- 第十七条 单位之间发生的林木、林地所有权和使用权争议，由县级以上人民政府依法处理。 Article 17 A dispute between organizations in connection with the ownership and the use right of trees and woodlands, it shall be up to the people's government above the county level to resolve it according to the law.
- 第十七条 对于在噪声敏感建筑物集中区域内造成严重环境噪声污染的企业事业单位，限期治理。 Article 17 Any enterprise or institution that produces serious environmental noise pollution in an area where noise-sensitive structures are concentrated shall be ordered to control the pollution within a time limit.
- 第十七条在江河、湖泊上建设防洪工程和其他水工程、水电站等，应当符合防洪规划的要求；水库应当按照防洪规划的要求留足防洪库容。 Article 17 Construction of flood control works or other hydraulic works and hydropower s tat ions in rivers and lakes should conform to the requirements of flood control planning. Reservoirs should keep adequate storage capacity for flood control according to the requirements of flood control planning.
- 第十七条 县级以上城市商务主管部门应当会同发展改革（经贸）、公安、工商、环保、建设、城乡规划等行政管理部门，按照统筹规划、合理布局的原则，根据本地经济发展水平、人口密度、环境和资源等具体情况，制定再生资源回收网点规划。 Article 17 Departments of commercial administration above county-level shall, in collaboration with department of development and reform (economic and trade), public security, industry and commerce, environmental protection, construction, rural and urban planning, formulate program of renewable resources recovery net in line with specific status of development level of local economy, population density, environment and resource as well according to principals of overall planning and rational distribution.
- 第十七条探矿权转让申请书、采矿权转让申请书的格式，由国务院地质矿产主管部门统一制定。 Article 17 Formats of the letter of application for the transfer of mineral exploration right and the letter of application for the transfer of mining right shall be uniformly determined by the competent department of geology and mineral resources under the State Council.
