- 铁路机车有第一款违法行为的，由铁路主管部门对有关责任人员给予行政处分。 If a railway locomotive is involved in the commission of the unlawful act mentioned in the first paragraph, the competent railway department shall impose administrative penalty on the person who is responsible for the act.
- 在保护区附近新建排污口，必须保证保护区水体不受污染。 If a sewage outlet is to be built in the vicinity of such protection zones, the water bodies within those zones must be protected against pollution.
- 造成渔业污染事故或者船舶造成水污染事故的，分别由事故发生地的渔政监督管理机构或者交通部门的航政机关根据所造成的危害和损失处以罚款。 If a unit causes a fishery pollution accident or a ship causes a water pollution accident, the fishery supervision and administration department or the navigation administration office of the communications department in the place where the accident occurs shall impose a fine on the unit or ship in light of the consequent damage and loss.
- 单位犯本条罪的，处以罚金，并对直接负责的主管人员和其他直接责任人员依照前款规定追究刑事责任。 If a unit commits a crime specified in this Article, it shall be imposed with a fine and the leading members of the unit who are directly in charge and other persons who are directly responsible for such an accident shall be investigated for criminal responsibility in accordance with the provisions of the preceding paragraph.
- 逾期不处置或者处置不符合国家有关规定的，由所在地县级以上地方人民政府环境保护行政主管部门指定单位按照国家有关规定代为处置，处置费用由产生危险废物的单位承担。 If a unit fails to treat the waste within the specified period of time, or if it has done it but not in conformity with the relevant State regulations, the competent administrative department of environmental protection of the local people's government at or above the county level shall assign other units to treat the waste in accordance with relevant State regulations, and, the units discharging hazardous waste shall bear the costs of treatment.
- 采取缴纳排污费措施的单位在限期内提前建成工业固体废物贮存或者处置的设施、场所或者经改造使其符合环境保护标准的，自建成或者改造完成之日起，不再缴纳排污费； If a unit that chooses to pay pollution discharge fee has completed the building of installations and sites for storage and treatment of industrial solid waste ahead of the time limit or through renovation has made such installations and sites conform to the standards within the time limit, the unit shall no longer pay the pollution discharge fee from the day of completion of the building or renovation;
- 造成水污染事故，情节较重的，对有关责任人员，由其所在单位或者上级主管机关给予行政处分。 If a water pollution accident is relatively serious, the persons who are responsible for the accident shall be given administrative sanctions by the unit to which they belong or by the competent department at a higher level.
- 凡超出工商行政管理部门核准的经营范围的，由工商行政管理部门按照有关规定予以处罚。 If an enterprise engages in what are beyond the business scope approved by industrial and commercial departments, it shall be imposed upon a punishment according to the relevant regulations.
- 被环保部门行政处罚的企业改正违法违规行为并通过环保部门验收后，环保部门及时向商务主管部门通报。 If an enterprise on which the environmental protection department imposes administrative punishments has corrected its unlawful or wrongful act and is discovered to be qualified upon check and acceptance of the environmental protection department, the environmental protection department shall timely issue a circular about it to the commerce department.
- 本单位无力治理的，由水行政主管部门治理，治理费用由造成水土流失的企业事业单位负担。 If an enterprise or institution is unable to carry out the rehabilitation, the department of water administration sha1l undertake the task, and the cost thus entailed shall be borne by the enterprise or institution that has caused the soil erosion.
- 对治安管理处罚不服的，依照治安管理处罚条例的规定办理。 If any party is not satisfied with a penalty for violation of public security, the case shall be handled according to the Regulations on Administrative Penalties for Public Security.
- 不按照经营许可证规定从事前款活动的，还可以由发证机关吊销经营许可证。 If any person or unit engages, against the provision of operation license, in activities specified in the preceding paragraph, his or its operation license may also be revoked by the department that issued the license.
- 采伐护堤护岸林木的，须经河道、湖泊管理机构同意后，依法办理采伐许可手续，并完成规定的更新补种任务。 If anyone intends to fell them, he must obtain the consent from administrative agencies for river courses and lakes, go through the formalities for a felling licence and complete the task of regeneration and planting of trees a s required.
- 伪造、倒卖特许猎捕证或者允许进出口证明书，情节严重、构成犯罪的，比照刑法第一百六十六条的规定追究刑事责任。 If anyone who forges or sells or resells a special hunting and catching license or an import or export permit, and if the circumstances are serious enough to constitute a crime, he shall be prosecuted for criminal responsibility by applying mutatis mutandis the provisions of Article 167 of the Criminal Law.
- 违反本法规定，未取得持枪证持枪猎捕野生动物的，由公安机关比照治安管理处罚条例的规定处罚。 If anyone, in violation of the provisions of this Law, hunts wildlife with a hunting rifle without a license for the rifle, he shall be punished by a public security organ by applying mutatis mutandis the provisions of the Regulations on Administrative Penalties for Public Security.
- 违反本法规定，出售、收购国家重点保护野生动物或者其产品，情节严重、构成投机倒把罪、走私罪的，依照刑法有关规定追究刑事责任。 If anyone, in violation of the provisions of this Law, sells or purchases wildlife under special state protection or the products thereof, and if the circumstances are serious enough to constitute a crime of speculation or smuggling, he shall be prosecuted for criminal responsibility according to the relevant provisions of the Criminal Law.
- 使用不符合使用要求的雷电灾害防护装置给他人造成损失的，依法承担赔偿责任。 If by using such devices it/he causes losses to others, it/he shall bear compensation responsibility in accordance with law.
- 造成损坏的，依法承担民事责任；应当给予治安管理处罚的，依照治安管理处罚条例的规定处罚；构成犯罪的，依法追究刑事责任。 If damage has been caused, the violator shall bear civil liability according to law. Should an administrative penalty be given, the Regulations on Administrative Penalties for Public Security shall apply. If a crime has been constituted, criminal liability shall be investigated according to law．
- 前款工程设施需要占用河道、湖泊管理范围内土地，跨越河道、湖泊空间或者穿越河床的，建设单位应当经有关水行政主管部门对该工程设施建设的位置和界限审查批准后，方可依法办理开工手续；安排施工时，应当按照水行政主管部门审查批准的位置和界限进行。 If engineering structures mentioned in the preceding paragraph need to occupy land within the scope of control for any river course or lake, or to cut across the space over any river course or lake, or to go through riverbeds, the construction unit should subject the pos it ion and border of the engineering structures to the examination and approval of the relevant water conservancy administrative department before completing the formalities for starting the projects according to law.
- ????完全由于不可抗拒的自然灾害，并经及时采取合理措施，仍然不能避免造成环境污染损害的，免予承担责任。 If environmental pollution losses result solely from irresistable natural disasters which cannot be averted even after the prompt adoption of reasonable measures, the party concerned shall be exempted from liability.
- 国家建设在民族自治地方征用或者使用草原，应当照顾民族自治地方的利益，作出有利于民族自治地方经济建设的安排。 If grasslands in national autonomous areas are to be requisitioned or used for state construction, due consideration shall be given to the interests of the national autonomous areas and arrangements made in favour of the economic development of those areas.
- 国家建设使用集体长期固定使用的全民所有的草原，参照《国家建设征用土地条例》的规定，给予适当补偿，并妥善安置牧民的生产和生活。 If grasslands under ownership by the whole people that are assigned to collectives for long-term use are to be used for state construction, due compensation shall be paid to the collectives concerned and proper arrangements made for the productive pursuits and livelihood of herdsmen with reference to the provisions of the Regulations Concerning Land Requisition for State Construction.
- 给他人造成损失的，依法承担赔偿责任； If it causes losses to others, it shall bear compensation responsibility in accordance with law.
- 发现引进的畜禽遗传资源对境内畜禽遗传资源、生态环境有危害或者可能产生危害的，国务院畜牧兽医行政主管部门应当商有关主管部门，采取相应的安全控制措施。 If it is found that imported livestock or poultry genetic resource does or may do harm to domestic livestock or poultry genetic resource, stockbreeding and veterinary administrative department of the State Council shall adopt corresponding safety control measures with relevant administrative departments.
- 确有必要进口列入前款规定目录中的固体废物用作原料的，必须经国务院环境保护行政主管部门会同国务院对外经济贸易主管部门审查许可，方可进口。 If it is really necessary to import as raw material the solid waste that is included in the catalog stipulated in the preceding paragraph, examination must be conducted by the competent administrative department of environmental protection in conjunction with the competent administrative department of foreign economic relations and trade under the State Counicl and permission must be obtained from them in advance.
