  第十七条? 发包单位及其工作人员在建筑工程发包中不得收受贿赂、回扣或者索取其他好处。    Article 17 Contract awarding units and their staff shall not take bribery, commissions or seek other benefits in the process of contract awarding for construction projects.
第十七条各级人民政府应当依据国民经济和社会发展规划、国土整治和资源环境保护的要求、土地供给能力以及各项建设对土地的需求,组织编制土地利用总体规划。    Article 17 People's governments at all levels shall manage to compile general plans for land uses in accordance with the national economic and social development program, requirements of national land consolidation and resources and environmental protection, land supply capacity and the requirements of various construction projects.
第十七条 外商投资建筑业企业的资质等级标准执行国务院建设行政主管部门颁发的建筑业企业资质等级标准。    Article 17 The criteria of grading of qualifications of foreign-invested construction enterprises shall be in accordance with the criteria of grading of construction enterprise qualifications formulated and issued by the construction administration department of the State Council.
  第十七条 土地使用者应当按照土地使用权出让合同的规定和城市规划的要求,开发、利用、经营土地。    Article 17. The land user shall, in conformity with the stipulations of the contract for the assignment of the right to the use of land and the requirements of city planning, develop, utilize and manage the land.
第十八条(参照执行)    Article 18 (For Reference in Implementation)
  第十八条? 建筑工程造价应当按照国家有关规定,由发包单位与承包单位在合同中约定。公开招标发包的,其造价的约定,须遵守招标投标法律的规定。    Article 18 Construction cost of the projects shall be agreed upon in the contracts by both the contractors and the out-contracting units in accordance with relevant regulations of the State. For projects subject to public bidding, the construction cost shall be agreed upon in line with the provisions of the tendering law.
第十八条下级土地利用总体规划应当依据上一级土地利用总体规划编制。    Article 18 General plans for land use at a lower level shall be compiled according to the general plans for the utilization of land at the next higher level.
第十八条 承揽施工总承包工程的外商投资建筑业企业,建筑工程主体结构的施工必须由其自行完成。    Article 18 Where a foreign-invested construction enterprise undertakes a construction project as the contractor, it shall itself complete the main structure of the project.
  第十八条 土地使用者需要改变土地使用权出让合同规定的土地用途的,应当征得出让方同意并经土地管理部门和城市规划部门批准,依照本章的有关规定重新签订土地使用权出让合同,调整土地使用权出让金,并办理登记。    Article 18. If the land user needs to alter the purposes of land use as stipulated in the contract for assigning the right to the use of land, he shall obtain the consent of the assigning party and the approval of the land administration department and the urban planning department and shall, in accordance with the relevant provisions in this Chapter, sign a new contract for assigning the right to the use of the land, readjust amount of the assignment fee thereof, and undertake registration anew.
第十九条(应用解释部门)    Article 19 (Department Responsible for Interpretation of the Present Procedures)
  第十九条? 建筑工程依法实行招标发包,对不适于招标发包的可以直接发包。    Article 19 Construction projects shall be contracted through public bidding according to law and those not suitable for bidding can be contracted out directly.
第十九条土地利用总体规划按照下列原则编制:    Article 19 General plans for land use should be mapped out according to the following principles:
第十九条 外商投资建筑业企业与其他建筑业企业联合承包,应当按照资质等级低的企业的业务许可范围承包工程。    Article 19 Where a foreign-invested construction enterprise contracts for construction projects in the form of a consortium with other construction enterprises, the consortium shall contract for projects within the permitted scope of the lower qualification grade.
第十九条 土地使用权转让是指土地使用者将土地使用权再转让的行为,包括出售、交换和赠与。    Article 19. The transfer of the right to the use of the land refers to the land user's act of re-assigning the right to the use of the land, including the sale, exchange, and donation thereof.
第二条(适用范围)    Article 2 (Scope of Application)
  第二条? 在中华人民共和国境内从事建筑活动,实施对建筑活动的监督管理,应当遵守本法。本法所称建筑活动,是指各类房屋建筑及其附属设施的建造和与其配套的线路、管道、设备的安装活动。    Article 2 Construction activities and supervision of construction activities conducted within the territory of the People's Republic of China shall abide by this law.
第二条中华人民共和国实行土地的社会主义公有制,即全民所有制和劳动群众集体所有制。    Article 2 The People's Republic of China resorts to a socialist public ownership i.e. an ownership by the whole people and ownerships by collectives, of land.
第二条 在中华人民共和国境内设立外商投资建筑业企业,申请建筑业企业资质,实施对外商投资建筑业企业监督管理,适用本规定。    Article 2 These regulations shall apply to the establishment of foreign–invested construction enterprises within the territory of the People’s Republic of China, the application for construction enterprise qualifications and the administration and supervision of foreign–invested construction enterprises.
  第二条 国家按照所有权与使用权分离的原则,实行城镇国有土地使用权出让、转让制度,但地下资源、埋藏物和市政公用设施除外。    Article 2. The State, in accordance with the principle of the ownership being separated from the right to the use of the land, implements ten system whereby the right to the use of the State-owned land in the urban areas may be assigned and transferred, with the exclusion of the underground resources, the objects buried underground, and the public works.
第二十条(施行日期和有关事项的处理)    Article 20 (Date of Implementation and Handling of Other Related Matters)
  第二十条? 建筑工程实行公开招标的,发包单位应当依照法定程序和方式,发布招标公告,提供载有招标工程的主要技术要求、主要的合同条款、评标的标准和方法以及开标、评标、定标的程序等内容的招标文件。    Article 20 For construction projects subject to open bidding, the out- contracting units shall, in accordance with legal procedures and methods, publish invitations for bid and provide tender documents containing major technical requirements of the projects subject to bidding, key contract terms, standards and methods for evaluation of bids as well as the procedures for the opening, evaluation and determination of bids.
第二十条县级土地利用总体规划应当划分土地利用区,明确土地用途。    Article 20 General plans for land use at the county level should define the areas and purposes of land use.
第二十条 外资建筑业企业违反本规定第十五条,超越资质许可的业务范围承包工程的,处工程合同价款2%以上4%以下的罚款;    Article 20 Where a foreign-invested construction enterprise contracts for construction projects beyond the permitted scope of its qualifications in violation of Article 15 of these Regulations, a fine at an amount between 2% to 4% of the construction contract price shall be collected.
  第二十条 土地使用权转让应当签订转让合同。    Article 20. A transfer contract shall be sighed for the transfer of the right to the use of the land.
第二十一条土地利用总体规划实行分级审批。    Article 21 General plans for land use shall be examined and approved level by level.
