第四十条 用人单位在下列节日期间应当依法安排劳动者休假:(一)元旦;    Article 40 The employing unit shall arrange holidays for labourers in accordance with the law during the following festivals: ??????the New Year’s Day;
第四十条 工会所属的为职工服务的企业、事业单位,其隶属关系不得随意改变。    Article 40 The jurisdictional framework of those enterprises and public institutions servicing workers which are subordinate to trade unions shall not be altered arbitrarily.
第四十条 劳动者可以在用人单位所在地或者本人居住地依法承担职业病诊断的医疗卫生机构进行职业病诊断。    Article 40 The laborer can have the occupational disease diagnosed by the occupational-disease-specific healthcare agency at the location of the Employer or at the residential place of the laborer.
第四十条 劳动者有权查阅、复印其本人职业健康监护档案。    Article 40 The workers shall have the right to consult or copy their own archives of occupational health surveillance.
第四十条 有下列情形之一的,用人单位提前三十日以书面形式通知劳动者本人或者额外支付劳动者一个月工资后,可以解除劳动合同:    Article 40. A Unit may dissolve a labor contract by giving the laborer 30 days prior written notice, or one month’s wage in lieu of notice, if:
第四十一条 有下列情形之一,需要裁减人员二十人以上或者裁减不足二十人但占企业职工总数百分之十以上的,用人单位提前三十日向工会或者全体职工说明情况,听取工会或者职工的意见后,裁减人员方案经向劳动行政部门报告,可以裁减人员:    Article 41 In the case of any of the following circumstances, if the employer needs to cut down above 20 workers, or if it needs to cut down less than 20 workers but which accounts for 10 percent or above of the total number of the workers, the employer shall make an explanation to the labor union or to all workers 30 days in advance. After it has solicited the opinions of the labor union or of the workers, it may have the reduction after reporting the plan to labor administrative department:
第四十一条 县级以上各级工会的离休、退休人员的待遇,与国家机关工作人员同等对待。    Article 41 Persons retiring from positions with trade unions at county level or above shall receive the same benefits as persons working for State organs.
第四十一条 用人单位由于生产经营需要,经与工会和劳动者协商后可以延长工作时间,一般每日不得超过一小时;因特殊原因需要延长工作时间的,在保障劳动者身体健康的条件下延长工作时间每日不得超过三小时,但是每月不得超过三十六小时。    Article 41 The employing unit may extend working hours due to the requirements of its production or business after consultation with the trade union and labourers, but the extended working hour for a day shall generally not exceed one hour; if such extension is called for due to special reasons, the extended hours shall not exceed three hours a day under the condition that the health of labourers is guaranteed. However, the total extension in a month shall not exceed thirty six hours.
第四十一条 职业病诊断标准和职业病诊断、鉴定办法由国务院卫生行政部门制定。职业病伤残等级的鉴定办法由国务院劳动保障行政部门会同国务院卫生行政部门制定。    Article 41 The public health authority under the State Council will provide for the occupational-disease diagnosis standard/measures and occupational-disease appraisal measures. The measures for the appraisal of occupational-disease-related disability classes should be provided for by the labor and social security authority under the State Council.
第四十一条 用人单位按照国家规定参加工伤保险的,患职业病的劳动者有权按照国家有关工伤保险的规定,享受下列工伤保险待遇:    Article 41 Where an employing unit has bought work injury insurance for its workers in accordance with the provisions of the State, the workers who suffer from occupational diseases shall have the right to enjoy the following benefits of the work injury insurance in accordance with the provisions of the State on work injury insurance:
第四十一条 有下列情形之一,需要裁减人员二十人以上或者裁减不足二十人但占企业职工总数百分之十以上的,用人单位提前三十日向工会或者全体职工说明情况,听取工会或者职工的意见后,裁减人员方案经向劳动行政部门报告,可以裁减人员:    Article 41. If any of the following circumstances obstruct implementation of the labor contract and make it necessary to reduce the workforce by 20 persons or more or by a number of persons that is less than 20 but accounts for 10 percent or more of the total number of the enterprise’s employees, the Unit shall explain the circumstances to its labor union or to all of its employees 30 days in advance, and it may reduce the workforce after considering the opinions of the labor union or the employees and subsequently reporting the workforce reduction plan to the labor administration department:
第四十二条 劳动者有下列情形之一的,用人单位不得依照本法第四十条、第四十一条的规定解除劳动合同:    Article 42 In the case of any of the following circumstances occurring to a worker, the employer may not discharge the labor contract in accordance with Articles 40 and 41 of this Law:

第四十二条 有下列情形之一的,延长工作时间不受本法第四十一条规定的限制:    Article 42 The extension of working hours shall not be subject to restriction of the provisions of Article 41 of this Law under any of the following circumstances: ????where emergent dealing is needed in the event of natural disaster, accident ????or other reason that threatens the life, health and the safety of property ????of labourers;
第四十二条 本法自公布之日起施行。1950年6月29日中央人民政府颁布的《中华人民共和国工会法》同时废止。    Article 42 This Law shall take effect from the date of promulgation. The Trade Union Law of the People's Republic of China, issued 29 June 1950 by the People's Central Government, shall be annulled simultaneously
第四十二条 用人单位未参加工伤保险的,其劳动者从事有毒物品作业患职业病的,用人单位应当按照国家有关工伤保险规定的项目和标准,保证劳动者享受工伤待遇。    Article 42 Where an employing unit has not bought work injury insurance, it shall, when its workers engaging in the operations in which toxic substances are used suffer from occupational diseases, guarantee that such workers enjoy the welfare benefits for work injury in accordance with the items and standards of the work injury insurance prescribed by the State.
第四十二条 劳动者有下列情形之一的,用人单位不得依照本法第四十条、第四十一条的规定解除劳动合同:    Article 42. A Unit may not dissolve a labor contract pursuant to Article 40 or Article 41 hereof if the laborer:
第四十三条 用人单位单方解除劳动合同,应当事先将理由通知工会。    Article 43 Any employer that discharges a labor contract unilaterally shall notify the labor union with relevant explanations.
第四十三条 用人单位不得违反本法规定延长劳动者的工作时间。    Article 43 The employing unit shall not extend working hours of labourers in violation of the provisions of this Law.
第四十三条 用人单位和医疗卫生机构发现职业病病人或者疑似职业病病人时,应当及时向所在地卫生行政部门报告。确诊为职业病的,用人单位还应当向所在地劳动保障行政部门报告。    Article 43 Upon identification of the patients suffering from occupational diseases or occupational-disease-like diseases, the Employer and healthcare agencies should report to the local public-health authority. The Employer should also report to the local labor & social security authority about the diagnosed occupational disease.
第四十三条 用人单位无营业执照以及被依法吊销营业执照,其劳动者从事使用有毒物品作业患职业病的,应当按照国家有关工伤保险规定的项目和标准,给予劳动者一次性赔偿。    Article 43 Where an employing unit has no business license or its business license has been revoked according to law, it shall, when its workers engaging in the operations in which toxic substances are used suffer from occupational diseases, make compensation in one lump sum for these workers in accordance with the items and standards of the work injury insurance prescribed by the State.
第四十三条 用人单位单方解除劳动合同,应当事先将理由通知工会。    Article 43. When a Unit is to dissolve a labor contract unilaterally, it shall give the labor union notice of the reasons in advance.
第四十四条 有下列情形之一的,劳动合同终止:    Article 44 In the case of any of the following circumstances, labor contracts shall be terminated:
第四十四条 有下列情形之一的,用人单位应当按照下列标准支付高于劳动者正常工作时间工资的工资报酬:    Article 44 The employing unit shall, according to the following standards, pay labourers remunerations higher than those for normal working hours under any of the following circumstances: ???
第四十四条 县级以上地方人民政府卫生行政部门负责本行政区域内的职业病统计报告的管理工作,并按照规定上报。    Article 44 The public health authority under the county-above people’s government is responsible for the administration of the occupational-disease statistics/report within its administrative jurisdiction and report to line authorities according to applicable regulations.
