第四十四条 用人单位分立、合并的,承继单位应当承担由原用人单位对患职业病的劳动者承担的补偿责任。    Article 44 Where an employing unit is divided or merged, the successors shall bear the former employing unit’s liabilities of compensation for the workers who suffer from occupational diseases.

第四十五条 劳动者除依法享有工伤保险外,依照有关民事法律的规定,尚有获得赔偿的权利的,有权向用人单位提出赔偿要求。    Article 45 In addition to the work injury insurance, the workers shall also have the right to claim for compensation from the employing unit if they are entitled to obtain compensation in accordance with the provisions of relevant civil laws.
第四十五条 当事人对职业病诊断有异议的,可以向作出诊断的医疗卫生机构所在地地方人民政府卫生行政部门申请鉴定。    Article 45 In case of disagreement with the occupational-disease diagnosis, the party concerned can apply to the public health authority under the people’s government in the locus of the responsible healthcare agency.
第四十五条 国家实行带薪年休假制度。劳动者连续工作一年以上的,享受带薪年休假。具体办法由国务院规定。    Article 45 The State shall practise a system of annual vacation with pay. Labourers who have kept working for one year and more shall be entitled to annual vacation with pay. The concrete measures shall be formulated by the State Council.
第四十五条 劳动合同期满,有本法第四十二条规定情形之一的,劳动合同应当续延至相应的情形消失时终止。    Article 45 Where a labor contract expires, if it is under any of the circumstances as prescribed in Article 42 of this Law, the term of labor contract shall be corresponding extended when the relevant circumstance disappears.
第四十五条 劳动合同期满,有本法第四十二条规定情形之一的,劳动合同应当续延至相应的情形消失时终止。    Article 45. If a labor contract expires but any of the circumstances specified in Article 42 hereof apply, the term of the labor contract shall be extended in accordance with the law until the relevant circumstance ceases, at which point the contract terminates.
第四十六条 有下列情形之一的,用人单位应当向劳动者支付经济补偿:    Article 46 In the case of any of the following circumstances, employers shall make an economic compensation to the workers:
第四十六条 工资分配应当遵循按劳分配原则,实行同工同酬。    Article 46 The distribution of wages shall follow the principle of distribution according to work and equal pay for equal work.
第四十六条 职业病诊断鉴定委员会由相关专业的专家组成。    Article 46 The occupational-disease-diagnosis appraisal committee should consist of the experts in related study fields.
第四十六条 劳动者应当学习和掌握相关职业卫生知识,遵守有关劳动保护的法律、法规和操作规程,正确使用和维护职业中毒危害防护设施及其用品;发现职业中毒事故隐患时,应当及时报告。    Article 46 The workers shall learn and master the knowledge of occupational health, abide by the relevant laws and regulations on labor protection as well as the operating rules, and correctly use and maintain safeguards and protective appliances against occupational poisoning hazards. When finding potential occupational poisoning accidents, they shall make reports in time.
第四十六条 有下列情形之一的,用人单位应当向劳动者支付经济补偿:    Article 46. In any of the following circumstances, the Unit shall pay economic compensation at the rate prescribed by the State Council:
第四十七条 县级以上人民政府卫生行政部门应当依照本条例的规定和国家有关职业卫生要求,依据职责划分,对作业场所使用有毒物品作业及职业中毒危害检测、评价活动进行监督检查。    Article 47 The administrative departments for public health of the people's governments at or above the county level shall, in accordance with the provisions of these Regulations and the relevant requirements of the State for occupational health, supervise and inspect ex officio the use of toxic substances in workplaces and the test and evaluation of occupational poisoning hazards.
第四十七条 经济补偿按劳动者在本单位工作的年限,每满一年支付一个月工资的标准向劳动者支付。六个月以上不满一年的,按一年计算;不满六个月的,向劳动者支付半个月工资的经济补偿。    Article 47 The economic compensation shall be paid to workers according to the number of years he has worked for the employer by the rate of one month's salary for each full year he worked. Any period of above six months but less than one year shall be deemed as one year. The economic compensations that are paid to a worker for any period of less than six months shall be one-half of his monthly salary.
第四十七条 用人单位根据本单位的生产经营特点和经济效益,依法自主确定本单位的工资分配方式和工资水平。    Article 47 The employing unit shall independently determine its form of wage distribution and wage level for its own unit according to law and based on the characteristics of its production and business and economic results.
第四十七条 职业病诊断鉴定委员会组成人员应当遵守职业道德,客观、公正地进行诊断鉴定,并承担相应的责任。职业病诊断鉴定委员会组成人员不得私下接触当事人,不得收受当事人的财物或者其他好处,与当事人有利害关系的,应当回避。    Article 47 The members of the occupational-disease-diagnosis appraisal committee should adhere to the professional ethics to ensure objective and just appraisal and bear the liability therein. The members of the occupational-disease-diagnosis appraisal committee are prohibited from contacting with the party concerned in private, accepting the bribery or other benefits of the party concerned. The committee members having interest relations with the party concerned should be excluded from the appraisal concerned.
第四十七条 经济补偿按劳动者在本单位工作的年限,每满一年支付一个月工资的标准向劳动者支付。    Article 47. The economic compensation calculation rate is based on the number of years the laborer worked in the Unit. Economic compensation equivalent to one month’s wages should be paid to the laborer for every one year he has worked in the Unit.
第四十八条 用人单位违反本法规定解除或者终止劳动合同,劳动者要求继续履行劳动合同的,用人单位应当继续履行;    Article 48 In the case of any employer discharges or terminates a labor contract that violates this Law, if any worker requests for continual performance of the contract, the employer shall do so as required.
第四十八条 卫生行政部门应当建立、健全监督制度,核查反映用人单位有关劳动保护的材料,履行监督责任。    Article 48 The administrative departments for public health shall establish and improve the supervisory system, checked the materials relating to the employing units' labor protection, and fulfill the supervisory responsibilities.
第四十八条 职业病诊断、鉴定需要用人单位提供有关职业卫生和健康监护等资料时,用人单位应当如实提供,劳动者和有关机构也应当提供与职业病诊断、鉴定有关的资料。    Article 48 The Employer, laborers and related organizations should faithfully furnish any information in connection with occupational health and health custody needed for the diagnosis and appraisal of occupational diseases.
第四十八条 国家实行最低工资保障制度。最低工资的具体标准由省、自治区、直辖市人民政府规定,报国务院备案。    Article 48 The State shall implement a system of guaranteed minimum wages. Specific standards on minimum wages shall be determined by the people’s governments of provinces, autonomous regions or municipalities directly under the Central Government and reported to the State Council for the record.
第四十八条 用人单位违反本法规定解除或者终止劳动合同,劳动者要求继续履行劳动合同的,用人单位应当继续履行;    Article 48. If a Unit dissolves or terminates a labor contract in violation of this Law and the laborer demands continued performance of such contract, the Unit shall continue performing under the contract.
第四十九条 医疗卫生机构发现疑似职业病病人时,应当告知劳动者本人并及时通知用人单位。    Article 49 Any healthcare agency identifying the patient suffering from the occupational-disease-like diseases should promptly notify the laborer concerned and his (her) Employer.
第四十九条 卫生行政部门应当监督用人单位严格执行有关职业卫生规范。    Article 49 The administrative departments for public health shall supervise employing units’ strict implementation of the relevant occupational health standards.
第四十九条 确定和调整最低工资标准应当综合参考下列因素:    Article 49 The determination and readjustment of the standards on minimum wages shall be made with reference to the following factors in a comprehensive manner: ???
