- 保险公司的资金不得用于设立证券经营机构和向企业投资。 The funds of an insurance company shall not be applied to the establishment of any entity to trade bonds or securities or investment in enterprises.

- 承揽人不得擅自更换定作人提供的材料，不得更换不需要修理的零部件。 The hiree may not replace the materials supplied by the hirer without authorization, and may not replace any component which does not require repair.
- 持票人可以不按照汇票债务人的先后顺序，对其中任何一人、数人或者全体行使追索权。 The holder may exercise the right of recourse against any or several or all of the persons liable for the bill of exchange in disregard of the order of precedence.
- 持票人对汇票债务人中的一人或者数人已经进行追索的，对其他汇票债务人仍可以行使追索权。被追索人清偿债务后，与持票人享有同一权利。 The holder, who has exercised the right of recourse against one or several of the persons liable for the bill of exchange, may still exercise the right of recourse against other persons liable for the bill. After clearing off the liabilities, the person against whom the right of recourse is exercised has the same right as the holder thereof.
- 有违法所得的，并处没收违法所得；情节严重的，取消其一年至三年内参加依法必须进行招标的项目的投标资格并予以公告，直至由工商行政管理机关吊销营业执照。 the illegal gains therefrom, if any, shall be confiscated of concurrently; and if the circumstance is serious, his qualifications for taking part in bidding for projects subject to tender according to law for one to three years shall be cancelled and the cancellation shall be announced, or even his business license shall be revoked by the administrative department for industry and commerce.
- 有违法所得的，并处没收违法所得；情节严重的，取消其一年至二年内参加依法必须进行招标的项目的投标资格并予以公告，直至由工商行政管理机关吊销营业执照；构成犯罪的，依法追究刑事责任。 the illegal gains therefrom, if any, shall be confiscated of concurrently; if the circumstance is serious, his qualifications to take part in bidding of projects subject to tender shall be cancelled for one to two years and the cancellation shall be announced or even his business license shall be revoked by the administrative department for industry and commerce; and if a crime is constituted, criminal responsibility shall be demanded for according to law.
- 非法证券活动是一种典型的涉众型的违法犯罪活动，严重干扰正常的经济金融秩序，破坏社会和谐与稳定。从近期办理的一些案件看，非法证券活动具有以下特征： The illegal securities activities are a typical kind of activities of legal violations and crimes covering the mass, severely destroy the normal economic and financial order, and ruin the social harmony and stability. The illegal securities activities undertake the following characteristics in view of some cases handled recently:
- 被处罚的单位和个体工商户，其退还或者被收缴的非法所得，应当抵减其结案年度的销售收 入或者营业收入。 The illicit gains of a penalized unit or individual which are returned or confiscated shall be deducted from the annual sales income or operating revenue for the year in which the case is settled.
- 国有企业改建为公司的实施步骤和具体办法，由国务院另行规定。 The implementing procedures and detailed measures for reorganizing state-owned enterprises into companies shall be separately prescribed by the State Council.
- 各级各类外贸企业的进口业务，按照经贸部批准的进口商品经营范围和现行有关规定执行。 The import business of foreign trade companies at various levels and of various types shall be handled in accordance with the business scope of import commodities approved by the Ministry of Foreign Economic Relations and Trade and also with the existing pertinent provisions.
- 进口经营者凭国务院外经贸主管部门或者国务院有关经济管理部门发放的自动进口许可证明，向海关办理报关验放手续。 The import business operators shall present the automatic import license issued by the foreign trade department of the State Council or the relevant economic administrative departments of the State Council to the customs offices for handling the formalities of customs declaration.
- 出口经营者凭出口许可证管理部门发放的出口许可证，向海关办理报关验放手续。 The import business operators shall present the export license issued by the administrative departments of export quotas to the customs office for handling the formalities of customs declaration and examination.
- 进口经营者凭进口许可证管理部门发放的进口许可证，向海关办理报关验放手续。 The import business operators shall present the import license issued by the administrative departments of import quotas to the customs office for handling the formalities of customs declaration and examination.
- 邮寄凭证上注明的收件日期为送达日期。 The indicated date of receipt on the postal certificate shall be the date of service.
- 在边民互市或中外民贸市场开展经营活动的工商企业和个体工商户，应严格按照工商行政管理机关核准的经营范围和经营方式进行经营活动。 The industrial and commercial enterprises and individual industrialists or traders engaged in the frontier’s market of exchange and the frontier market of the Chinese and neighboring countries should conduct their trading activities sternly following the management range and pattern verified and approved by the administrative organs of industry and commerce.
