- （一）机电产品进口申请表（见附件1）； (1)An application form of import of mechanical and electronic products (see appendix 1);
- （二）营业执照复印件 (2)A duplicate of the business license;
- （二）申请可通过书面形式或网上申请方式提交。 (2)Applications can be submitted in written forms or online.
- （四）以欺骗或者其他不正当手段获取机电产品进口证件； (4)Acquirement of certificates for import of mechanical and electronic products by cheat or other illegal manners.
- （六）未按法定程序申请进口； (6)Application for import does not go through legal procedures;
- （二）、发电厂、变电所外各种专用管道（沟）、水井、泵站、冷却水塔、油库、堤坝、铁路、道路、桥梁、码头、燃料装卸设施、避雷针、消防设施及附属设施； 2. All kinds of special pipes and conduits (ditches), ash storage sites, wells, pumping stations, water cooling towers, oil depots, dikes and dams, railways, roads, bridges, docks, fuel loading and unloading equipment, lightening arresters, fire-fighting equipment and other related ancillary equipment outside power plants and power transformation stations.
- 1、进口国家实行强制性认证的机电产品的，应提供《中国国家强制性产品认证证书》或《免予办理强制性产品认证证明》； a.?The China Compulsory Certification or the Certificate of Exemption of China Compulsory Certification shall be provided if the mechanical and electronic products to be imported are subject to state compulsory certification.
- 1、书面申请程序：申请进口单位可到发证机构领取或从商务部授权网站（http://www.chinabidding.com/）下载（可复印）《机电产品进口申请表》，与其他相关书面材料一并提交到相应的主管机构。 a.?Written application procedures: entities applying for import can obtain the Application Form for Import of Mechanical and Electronic Products (copyable) from issuance agencies or download it from the website authorized by the MOFCOM (http://www.chinabidding.com/), and submit it with other relevant written materials to corresponding competent authorities.
- 违反本规定，安装空调设备擅自改变房屋承重结构，影响房屋安全的，由规划管理部门依照城市规划管理的有关规定予以处罚。 Acts of altering weight-bearing structure of buildings without authorization when installing air-conditioning equipment in violation of these Provisions and jeopardizing the safety of buildings shall be penalized by the planning administrative departments in accordance with the relevant regulations of the urban planning administration.
- 各级规划、市政、房地、公安、工商和电力管理部门应当根据各自的职责，协同环境保护部门实施本规定。 Administrative departments at all levels of planning, municipal administration, real estate, public security, industry and commerce, and electric power shall, in accordance with their respective functions, cooperate with the environmental protection departments in the implementation of these Provisions.
- 在电力设施周围进行爆破及其他可能危及电力设施安全的作业的，应当按照国务院有关电力设施保护的规定，经批准并采取确保电力设施安全的措施后，方可进行作业。 Any explosion operations that are conducted in the vicinity of power facilities, and other work that might endanger the safety of power facilities, shall be in accordance with regulations of the State Council concerning the protection of power facilities, conducted only after approval and definite measures for ensuring the safety of the power facilities are taken.
- 电力企业职工故意延误电力设施抢修或者抢险救灾供电，造成严重后果的，比照刑法第一百一十四条的规定追究刑事责任。 Any staff member or employee of an electric power enterprise who intentionally delays urgent repair and maintenance on electric power facilities or delays power supply for rescue and relief work and thereby causes serious consequences, shall be prosecuted for criminal liability according to the provisions of Article 114 of the Criminal Law.

- 申请新装用电、临时用电、增加用电容量、变更用电和终止用电，应当依照规定的程序办理手续。 Applications for new electricity utilization, temporary electricity utilization, increases in capacity of electricity utilization, as well as alteration and termination of electricity utilization shall accomplish the procedure as stipulated.
- 第一条（制定目的和依据）为了保护生活环境，维护城市市容，保障交通畅通、公共安全和人体健康，根据《上海市环境保护条例》和其他有关法律、法规，结合本市实际情况，制定本规定。 Article 1 Purpose and Basis With a view to protecting the living environment, maintaining the city appearance, and ensuring smooth traffic, public security and human health, these Provisions are formulated in accordance with the Regulations of Shanghai Municipality on Environmental Protection and other relevant laws and regulations, and in light of the actual circumstances of this Municipality.

- 第一条 为维护国家安全、社会公共利益，保护人的健康或者安全，保护动物、植物的生命或者健康，保护环境，依据《中华人民共和国对外贸易法》、《中华人民共和国进出口商品检验法》、《中华人民共和国行政许可法》、《中华人民共和国海关法》以及《中华人民共和国货物进出口管理条例》、《中华人民共和国进出口商品检验法实施条例》等相关法律和行政法规，制定本办法。 Article 1 With a view to maintaining state security and public interests, to protect health or safety of human, life or heath of fauna and flora and environment, these measures are formulated in accordance with the Foreign Trade Law of The People’s Republic of China, the Law of the People’s Republic of China on Import and Export Commodity Inspection, the Administrative License Law of the People’s Republic of China, the Customs Law of the People’s Republic of China, the Regulation of the People’s Republic of China on the Administration of the Import and Export of Goods, the Regulation of the People’s Republic of China on the Inspection of the Import and Export Commodities and other relevant laws and administrative regulations.
- 第一条为了对部分自由进口的机电产品的进口情况进行监测和统计，根据《中华人民共和国对外贸易法》、《中华人民共和国货物进出口管理条例》、《货物自动进口许可管理办法》及《机电产品进口管理办法》，制定本办法。 Article 1 With a view to undertake monitoring and collection of statistics of free import of some mechanical and electronic products, these Measures are formulated in accordance with the Foreign Trade Law of The People’s Republic of China, the Regulation of the People’s Republic of China on the Administration of the Import and Export of Goods, the Measures for Administration of Automatic Import License of Goods and the Measures for Administration of Import of Mechanical and Electronic Products.
- 第十条 进口旧船舶的申请进口单位，须提供第八条第一至第三款所列材料以及中华人民共和国海事局出具的《旧船舶进口技术评定书》或中华人民共和国渔业船舶检验局出具的《旧渔业船舶进口技术评定书》。 Article 10 Importers applying for import of used vessels shall provide materials listed in Item 1 to Item 3 of Article 8 as well as the Technical Assessment on the Imported Used Vessel by the Maritime Safety Administration PRC and the Technical Assessment on the Import Used Fishing Vessel by the Register of Fishing Vessel PRC.
- 第十条 电力线路保护区： Article 10 Power line protection zones:
- 第十条（建筑物内共用部位安装空调设备的限制）禁止在建筑物内的走道、楼梯、出口等共用部位安装空调设备。 Article 10 Restriction on the Installation of Air-conditioners in Shared Space of Buildings Installation of air-conditioners in shared space of buildings such as passages, stairways and exits shall be prohibited.
- 第十条申请进口单位所提交的材料不实的，商务部及地方、部门机电办可不予签发机电产品《进口自动许可证》。 Article 10 The MOFCOM and local and departmental mechanical and electronic offices can refuse issuance of the Automatic Import License if the materials submitted by entities applying for import are inaccurate.
- 第十条商务部会同海关总署、质检总局制定、调整并公布《限制进口机电产品目录》。限制进口的机电产品，实行配额、许可证管理。 Article 10 The MOFCOM together with the GAC and the GAQSIQ shall formulate, adjust and promulgate the Catalogue of Mechanical and Electronic Products under Restrictive Import Category. The mechanical and electronic products under restrictive import category are subject to quota and license administration.
