When permanent representative offices of foreign transport enterprises violate the rules hereof, MCT may warn, fine or punish them according to the seriousness of the cases and may, if it is of a serious nature, cancel the Document of Ratification for Establishment of Permanent Representative Offices and notify the administration of industry and commerce.
µÚÒ»°ÙÈýÊ®Ìõ¶¨ÆÚ×â´¬ºÏͬµÄÄÚÈÝ£¬Ö÷Òª°üÀ¨³ö×âÈ˺ͳÐ×âÈ˵ÄÃû³Æ¡¢´¬Ãû¡¢´¬¼®¡¢´¬¼¶¡¢¶Öλ¡¢ÈÝ»ý¡¢´¬ËÙ¡¢È¼ÁÏÏûºÄ¡¢º½Çø¡¢ÓÃ;¡¢×â´¬Æڼ䡢½»ºÍ»¹´¬µÄʱ¼äºÍµØµãÒÔ¼°Ìõ¼þ¡¢×â½ð¼°ÆäÖ§¸¶£¬ÒÔ¼°ÆäËûÓйØÊÂÏî¡£    Article 130 A time charter party mainly contains the name of the shipowner, the name of the charterer; the name, nationality, class, tonnage, capacity, speed and fuel consumption of the ship; the trading area; the agreed service, the contractual period, the time, place and conditions of delivery and redelivery of the ship; the hire and the way of its payment and other relevant matters.
µÚÒ»°ÙÈýÊ®ÌõÈκÎÖ¼ÔÚÃâ³ý±¾·¨¹æ¶¨µÄ³ÐÔËÈËÔðÈλòÕß½µµÍ±¾·¨¹æ¶¨µÄÅâ³¥ÔðÈÎÏÞ¶îµÄÌõ¿î£¬¾ùÊôÎÞЧ£»µ«ÊÇ£¬´ËÖÖÌõ¿îµÄÎÞЧ£¬²»Ó°ÏìÕû¸öº½¿ÕÔËÊäºÏͬµÄЧÁ¦¡£    Article 130 Any provision tending to relieve the carrier of the liability prescribed by this Law or to fix a lower limit than that which is laid down in this Law shall be null and void, but the nullity of any such provision shall not involve the nullity of the whole contract of transport by air.
µÚÒ»°ÙÈýʮһÌõÓйغ½¿ÕÔËÊäÖз¢ÉúµÄËðʧµÄËßËÏ£¬²»ÂÛÆä¸ù¾ÝÈçºÎ£¬Ö»ÄÜÒÀÕÕ±¾·¨¹æ¶¨µÄÌõ¼þºÍÅâ³¥ÔðÈÎÏÞ¶îÌá³ö£¬µ«ÊDz»·Á°­Ë­ÓÐȨÌáÆðËßËÏÒÔ¼°ËûÃǸ÷×ÔµÄȨÀû¡£    Article 131 Any action for damage occurred in air transport, however founded, can only be brought subject to the conditions and limits of liability set out in this Law, without prejudice to the question as to who are the persons who have the right to bring suit and what are their respective rights.
µÚÒ»°ÙÈýʮһÌõ³ö×âÈËÓ¦µ±°´ÕÕºÏͬԼ¶¨µÄʱ¼ä½»¸¶´¬²°¡£    Article 131 The shipowner shall deliver the ship within the time agreed upon in the charter party.
µÚÒ»°ÙÈýÊ®¶þÌõ³ö×âÈ˽»¸¶´¬²°Ê±£¬Ó¦µ±×öµ½½÷É÷´¦Àí£¬Ê¹´¬²°Êʺ½¡£    Article 132 At the time of delivery, the shipowner shall exercise due diligence to make the ship seaworthy.
µÚÒ»°ÙÈýÊ®¶þÌõ¾­Ö¤Ã÷£¬º½¿ÕÔËÊäÖеÄËðʧÊÇÓÉÓÚ³ÐÔËÈË»òÕßÆäÊܹÍÈË¡¢´úÀíÈ˵ĹÊÒâ»òÕßÃ÷Öª¿ÉÄÜÔì³ÉËðʧ¶øÇáÂʵØ×÷Ϊ»òÕß²»×÷ΪÔì³ÉµÄ£¬³ÐÔËÈËÎÞȨԮÓñ¾·¨µÚÒ»°Ù¶þÊ®°ËÌõ¡¢µÚÒ»°Ù¶þÊ®¾ÅÌõÓйØÅâ³¥ÔðÈÎÏÞÖƵĹ涨£»    Article 132 The carrier shall not be entitled to avail himself of the provisions of Articles 128 and 129 of this Law concerning the limit of liability if it is proved that the damage in the air transport resulted from an act or omission of the carrier, his servants or agents, done with intent to cause damage or recklessly and with knowledge that damage would probably result;
µÚÒ»°ÙÈýÊ®ÈýÌõ´¬²°ÔÚ×âÆÚÄÚ²»·ûºÏÔ¼¶¨µÄÊʺ½×´Ì¬»òÕßÆäËû״̬£¬³ö×âÈËÓ¦µ±²ÉÈ¡¿ÉÄܲÉÈ¡µÄºÏÀí´ëÊ©£¬Ê¹Ö®¾¡¿ì»Ö¸´¡£    Article 133 During the charter period, if the ship is found at variance with the seaworthiness or the other conditions agreed upon in the charter, the shipowner shall take all reasonable measures to have them restored as soon as possible.
µÚÒ»°ÙÈýÊ®ÈýÌõ¾Íº½¿ÕÔËÊäÖеÄËðʧÏò³ÐÔËÈ˵ÄÊܹÍÈË¡¢´úÀíÈËÌáÆðËßËÏʱ£¬¸ÃÊܹÍÈË¡¢´úÀíÈËÖ¤Ã÷ËûÊÇÔÚÊܹ͡¢´úÀí·¶Î§ÄÚÐÐʵģ¬ÓÐȨԮÓñ¾·¨µÚÒ»°Ù¶þÊ®°ËÌõ¡¢µÚÒ»°Ù¶þÊ®¾ÅÌõÓйØÅâ³¥ÔðÈÎÏÞÖƵĹ涨¡£    Article 133 If an action is brought against a servant or agent of the carrier arising out of damage during air transport, such servant or agent, if it proves that he acted within the scope of his employment, shall be entitled to avail himself of the limits of liability as provided in Articles 128 and 129 of this Law.
µÚÒ»°ÙÈýÊ®ËÄÌõÂÿͻòÕßÊÕ»õÈËÊÕÊÜÍÐÔËÐÐÀî»òÕß»õÎï¶øδÌá³öÒìÒ飬ΪÍÐÔËÐÐÀî»òÕß»õÎïÒѾ­ÍêºÃ½»¸¶²¢ÓëÔËÊäƾ֤Ïà·ûµÄ³õ²½Ö¤¾Ý¡£    Article 134 Receipt by the passenger of checked baggage or receipt of cargo by the consignee without complaint shall be prima facie evidence that the same have been delivered in good condition and in accordance with the document of transport.
µÚÒ»°ÙÈýÊ®ËÄÌõ³Ð×âÈËÓ¦µ±±£Ö¤´¬²°ÔÚÔ¼¶¨º½ÇøÄڵݲȫ¸Û¿Ú»òÕߵصãÖ®¼ä´ÓÊÂÔ¼¶¨µÄº£ÉÏÔËÊä¡£    Article 134 The charterer shall guarantee that the ship shall be employed in the agreed maritime transport between the safe ports or places within the trading area agreed upon.
µÚÒ»°ÙÈýÊ®ÎåÌõ³Ð×âÈËÓ¦µ±±£Ö¤´¬²°ÓÃÓÚÔËÊäÔ¼¶¨µÄºÏ·¨µÄ»õÎï¡£    Article 135 The charterer shall guarantee that the ship shall be employed to carry the lawful merchandise agreed.
µÚÒ»°ÙÈýÊ®ÎåÌõº½¿ÕÔËÊäµÄËßËÏʱЧÆÚ¼äΪ¶þÄ꣬×ÔÃñÓú½¿ÕÆ÷µ½´ïÄ¿µÄµØµã¡¢Ó¦µ±µ½´ïÄ¿µÄµØµã»òÕßÔËÊäÖÕÖ¹Ö®ÈÕÆð¼ÆËã¡£    Article 135 The time for bringing up an action concerning air transport is limited to two years, reckoned from the date of arrival of civil aircraft at the destination, or from the date on which the civil aircraft ought to have arrived, or from the date on which the transport stopped.
µÚÒ»°ÙÈýÊ®ÁùÌõÓɼ¸¸öº½¿Õ³ÐÔËÈË°ìÀíµÄÁ¬ÐøÔËÊ䣬½ÓÊÜÂÿ͡¢ÐÐÀî»òÕß»õÎïµÄÿһ¸ö³ÐÔËÈËÓ¦µ±Êܱ¾·¨¹æ¶¨µÄÔ¼Êø£¬²¢¾ÍÆä¸ù¾ÝºÏͬ°ìÀíµÄÔËÊäÇø¶Î×÷ΪÔËÊäºÏͬµÄ¶©Ô¼Ò»·½¡£    Article 136 In the case of transport to be performed by various successive carriers, each carrier who accepts passengers, baggage or cargo shall be subject to the provisions of this Law, and shall be deemed to be one of the contracting parties to the contract of transport in so far as that part of the transport is concerned which is performed by it in accordance with the contract.
µÚÒ»°ÙÈýÊ®ÁùÌõ³Ð×âÈËÓÐȨ¾Í´¬²°µÄÓªÔËÏò´¬³¤·¢³öָʾ£¬µ«ÊDz»µÃÎ¥·´¶¨ÆÚ×â´¬ºÏͬµÄÔ¼¶¨¡£    Article 136 The charterer shall be entitled to give the Master instructions with respect to the operation of the ship. However, such instructions shall not be inconsistent with the stipulations of the time charter.
µÚÒ»°ÙÈýÊ®ÆßÌõ±¾½ÚËù³ÆµÞÔ¼³ÐÔËÈË£¬ÊÇÖ¸ÒÔ±¾ÈËÃûÒåÓëÂÿͻòÕßÍÐÔËÈË£¬»òÕßÓëÂÿͻòÕßÍÐÔËÈ˵ĴúÀíÈË£¬¶©Á¢±¾Õµ÷ÕûµÄº½¿ÕÔËÊäºÏͬµÄÈË¡£    Article 137 Contracting carrier referred to in this Section means any person who has concluded a contract of transport by air subject to the regulations of this Chapter in his own name with a passenger or a shipper, or with the agent of a passenger or of a shipper.
µÚÒ»°ÙÈýÊ®ÆßÌõ³Ð×âÈË¿ÉÒÔ½«×âÓõĴ¬²°×ª×⣬µ«ÊÇÓ¦µ±½«×ª×âµÄÇé¿ö¼°Ê±Í¨Öª³ö×âÈË¡£    Article 137 The charterer may sublet the ship under charter, but he shall notify the shipowner of the sublet in time.
µÚÒ»°ÙÈýÊ®°ËÌõ³ý±¾½ÚÁíÓй涨Í⣬µÞÔ¼³ÐÔËÈ˺Íʵ¼Ê³ÐÔËÈ˶¼Ó¦µ±Êܱ¾Õ¹涨µÄÔ¼Êø¡£µÞÔ¼³ÐÔËÈËÓ¦µ±¶ÔºÏͬԼ¶¨µÄÈ«²¿ÔËÊ为Ôð¡£    Article 138 Both the contracting carrier and the actual carrier shall, except as otherwise provided in this Section, be subject to the provisions of this Chapter. The contracting carrier shall be responsible for the whole of the transport contemplated in the contract.
µÚÒ»°ÙÈýÊ®°ËÌõ´¬²°ËùÓÐÈËתÈÃÒѾ­×â³öµÄ´¬²°µÄËùÓÐȨ£¬¶¨ÆÚ×â´¬ºÏͬԼ¶¨µÄµ±ÊÂÈ˵ÄȨÀûºÍÒåÎñ²»ÊÜÓ°Ï죬µ«ÊÇÓ¦µ±¼°Ê±Í¨Öª³Ð×âÈË¡£    Article 138 Where the ownership of the ship under charter has been transferred by the shipowner, the rights and obligations agreed upon under the original charter shall not be affected. However, the shipowner shall inform the charterer thereof in time.
µÚÒ»°ÙÈýÊ®¾ÅÌõÔÚºÏͬÆڼ䣬´¬²°½øÐк£ÄѾÈÖúµÄ£¬³Ð×âÈËÓÐȨ»ñµÃ¿Û³ý¾ÈÖú·ÑÓá¢ËðʧÅâ³¥¡¢´¬Ô±Ó¦µÃ²¿·ÖÒÔ¼°ÆäËû·ÑÓúóµÄ¾ÈÖú¿îÏîµÄÒ»°ë¡£    Article 139 Should the ship be engaged in salvage operations during the charter period, the charterer shall be entitled to half of the amount of the payment for salvage operations after deducting therefrom the salvage expenses, compensation for damage, the portion due to crew members and other relevant costs.
µÚÒ»°ÙÈýÊ®¾ÅÌõʵ¼Ê³ÐÔËÈ˵Ä×÷ΪºÍ²»×÷Ϊ£¬Êµ¼Ê³ÐÔËÈ˵ÄÊܹÍÈË¡¢´úÀíÈËÔÚÊܹ͡¢´úÀí·¶Î§ÄÚµÄ×÷ΪºÍ²»×÷Ϊ£¬¹Øϵµ½Êµ¼Ê³ÐÔËÈËÂÄÐеÄÔËÊäµÄ£¬Ó¦µ±ÊÓΪµÞÔ¼³ÐÔËÈ˵Ä×÷ΪºÍ²»×÷Ϊ¡£    Article 139 The acts and omissions of an actual carrier and of his servants and agents acting within the scope of their employment shall, in relation to the transport performed by the actual carrier, be deemed to be also those of the contracting carrier.
µÚÊ®ÈýÌõ¡¡Ãñº½¾ÖÒÀ·¨×ö³öÅú×¼¾ö¶¨ºó£¬×Ô×ö³öÅú×¼¾ö¶¨Ö®ÈÕÆðÊ®¸ö¹¤×÷ÈÕÄÚÏòÍ⺽°ä·¢¾­ÓªÐí¿É¡£Ãñº½¾ÖÒÀ·¨×ö³ö²»ÓèÅú×¼¾ö¶¨µÄ£¬ÏòÍ⺽³ö¾ßÊéÃæ¾ö¶¨²¢ËµÃ÷ÀíÓÉ¡£    Article 13¡¡After Civil Aviation Administration makes approving decision, they shall issue business licenses to foreign airlines within 10 working days after the approval. If Civil Aviation Administration decides not to approve, they shall issue written explanation for the reason to the foreign airlines.
µÚÊ®ËÄÌõÂÿͳ˳µÓ¦µ±³ÖÓÐЧ³µÆ±¡£¶ÔÎÞƱ³Ë³µ»òÕß³ÖʧЧ³µÆ±³Ë³µµÄ£¬Ó¦µ±²¹ÊÕƱ¿î£¬²¢°´Õչ涨¼ÓÊÕƱ¿î£»¾Ü²»½»¸¶µÄ£¬Ìú·ÔËÊäÆóÒµ¿ÉÒÔÔðÁîϳµ¡£    Article 14 Any passenger boarding a train shall hold a valid passenger ticket. Any passenger riding on a train without a ticket or with an invalid ticket shall pay the ticket fare on the train plus such additional charges as specified in relevant railway regulations; the railway transport enterprise may order any passenger who refuses to do so to leave the train.
µÚÊ®ËÄÌõ ±£Ë°ÇøÄÚµÄÉú²úÆóÒµÓ¦Ïòº£¹Ø±¸°¸£¬ÁìÈ¡Óйء¶µÇ¼ÇÊֲᡷ¡£    Article 14 Enterprises destined for production in the bonded area shall register at the Customs for the record, and obtain a ""registration handbook"".
µÚÊ®ËÄÌõ¹«Â·Ö÷¹Ü²¿ÃŸºÔð¶Ô¹«Â·½¨É蹤³ÌµÄÖÊÁ¿½øÐмලºÍ¼ìÑ顣ĩ°´¹ú¼ÒÓйع涨ÑéÊպϸñµÄ¹«Â·£¬²»µÃ½»¸¶Ê¹Óᣠ   Article 14 Highway departments are responsible for the quality supervision and inspection of highway construction projects. Highways that have not been checked in accordance with relevant state regulations before acceptance, should not be made available for use.
